أصبحت وسائل التواصل الاجتماعي وسيلة مهمة للغاية لاطلاع الناس على الأخبار اليومية والحياتية ونشر الثقافات المختلفة، سواء الدينية، أو الاقتصادية، أو الاجتماعية، أو السياسية، أو غيرها، ولا نغالي في القول بأن كثرة متابعي ومستخدمي وسائل التواصل الاجتماعي أدى إلى افتعال أزمة حادة تحتاج إلى حزمة من التدابير والإجراءات والتشريعات لتنظيم التعامل معها واحتوائها للحد من أزمة تداول الشائعات على الصفحات الشخصية عبر وسائل التواصل الاجتماعي، والتي تعد فضاء للتعبير عن الآراء الذاتية والتوجيهات السياسية والشخصية، تلك الصفحات لا يمكننا غض الطرف عن المشكلات القانونية التي تنجم عن استخدامها، وذلك لعدم خضوعها لمظلة قانونية منضبطة تنظم أسلوب التعامل معها، وما ينشر عبرها والذي في كثير من الأحيان ينطوي على أكاذيب وشائعات، سواء عمدًا أو بسبب الإهمال، وعدم التيقن من المحتوى المتداول، وذلك في ظل صعوبة الرقابة القانونية على وسائل التواصل الاجتماعي باعتبارها أحدث وسائل المعرفة والإعلام ومتابعة الأخبار اليومية وتطوراتها، ومدى فاعلية الرقابة على محتواها والتي تحاط من التعقيدات لاسيما مع التطورات التقنية في مجال تطبيقات الإنترنت، مع تداخل أطراف عديدة كوسيط بين طرفي العملية الاتصالية عبر تلك المواقع، والذي نتج عنه العديد من المشكلات القانونية التي صاحبت هذا النمط الجديد من تداول المعلومات، وذلك لغياب التنظيم القانوني لمستخدمي صفحات التواصل الاجتماعي- الفيس بوك- وغيرها من قنوات من شأنها نقل المعلومات، وتداول الأخبار الاجتماعية، والاقتصادية، والسياسية، والدينية، والتي قد تنطوي على شائعات من شأنها إلحاق الضرر بالآخر، والأكثر من ذلك التأثير على الغير، مما ينعكس بالسلب على خطط التنمية المستدامة بالمملكة العربية السعودية. Social media has become an essential means of informing people about daily news and spreading various cultures, whether religious, economic, social, political, or others. It is no exaggeration to say that the growing number of social media followers and users has led to a severe crisis that requires a set of measures, regulations, and legislations to control and contain it. This is especially necessary to curb the crisis of rumor circulation on personal pages via social media, which serve as a space for expressing personal opinions and political orientations. These pages bring about legal challenges due to their lack of a strict legal framework governing their use and the content published on them, which often includes lies and rumors, either intentionally or due to negligence and uncertainty about the shared content. The difficulty of legal oversight on social media, as the most modern means of knowledge, media, and news tracking, adds further complexity, particularly with technological advancements in internet applications and the involvement of multiple intermediaries in communication processes. This has led to several legal issues accompanying this new mode of information dissemination, primarily due to the absence of a legal framework governing social media users—whether on Facebook or other platforms that facilitate the transmission of information and the circulation of social, economic, political, and religious news. These platforms may spread rumors that cause harm to others and negatively impact sustainable development plans in the Kingdom of Saudi Arabia.
