تكريسًا لحماية حقوق الجنين، فقد حاول الإنسان من خلال الشريعة الإسلامية والقوانين الوضعية تم وضع قوانين وقواعد من شأنها أن تحكم وتنظم حياته وتحفظ حقوقه تحميه في الوجود، فاهتم بالأحكام المتعلقة بالحمل حتى وهو في بطن ولم يولد بعد، نجد من هذه القوانين من يقر للجنين شخصية قانونية تثبت بثبوت حقوقه، فشخصية الجنين تكون احتمالية ذلك لتعلقها بشرط الولادة ذلك أن الجنين لا يستطيع تحمل الالتزامات التي تقع عليه لعدم اكتمال أهليته، وتصبح شخصيته قانونية يقينية بتمام الولادة واستمرار حياته ولو لفترة قصيرة؛ باعتبار أن الجنين شخصي من أشخاص القانون، فله حقوق مكرسة شرعًا وقانونًا، مثل حق الميراث، والوصية، والبحث عن الطبيعة القانونية للجنين ينبغي أن يتوجه إلى تبيين مدى تمتع الجنين بالشخصية القانونية من عدمه حيث إن الفيصل في تحديد حكم أي تصرف يقع على الجنين يستلهم من معرفة مدى كون الجنين شخصًا قانونيًا أو لا، لذا تناولت الحديث عن حماية حقوق الجنين الشرعية والقانونية من خلال مبحث تمهيدي وفصلين، بينت في المبحث التمهيدي: ماهية الجنين ومراحل تكوين الجنين في رحم الأم. وكما تناولت في الفصل الأول: تقدير الشخصية القانونية والحياة الإنسانية للجنين والتحديد الشرعي والقانوني لبداية ونهاية الحمل. كما عرضت في الفصل الثاني: حماية حقوق الجنين في الشرع والقانون. من حيث حياة الجنين في الحياة داخل وخارج الرحم في الفقه الإسلامي والقانون الوضعي. مُتبعاً المنهج الوصفي والمنهج المقارن بين الشريعة والقانون. وقد اختتمت هذا البحث ببعض النتائج والتوصيات. In dedication to protecting fetal rights, both Islamic Sharia and statutory laws have sought to establish regulations that govern and safeguard the fetus's existence and rights. Legal provisions address the status of a fetus even before birth, recognizing a conditional legal personality that depends on birth. Since a fetus lacks full legal capacity, it cannot bear obligations. However, its legal personality becomes certain upon birth and continued survival, even for a short period. The fetus is considered a legal person with rights recognized both religiously and legally, such as inheritance, wills, and other protections. The legal nature of the fetus is essential in determining its legal status and the validity of actions concerning it. This study discusses the legal and Sharia protection of fetal rights through an introductory section and two chapters. The introductory section explores the definition and developmental stages of the fetus in the mother's womb. The first chapter examines the legal personality and human life of the fetus, as well as the legal and Sharia determination of the beginning and end of pregnancy. The second chapter discusses the protection of fetal rights in both Islamic jurisprudence and statutory law, covering the fetus's life inside and outside the womb. The study follows a descriptive and comparative methodology between Sharia and statutory law. The research concludes with findings and recommendations.
