يتناول هذا البحث المسالك التي جمع فيها العلماء بين قاعدتين وردتا على لسان الإمام الشافعي - رحمه الله -؛ حيث أوهمت بعض ألفاظهما التعارض؛ فادعاه البعض، ونفاه الأكثر، وكانت لهم مسالك في ذلك، والقاعدتان مشهورتان عن الإمام، لهما نص محكم يدل على استقراء نصوص السنة من قِبَلِهِ، وإلا لما كان له أن يصوغهما هذه الصياغة المحكمة؛ ونص الأولى منهما: (ترك الاستفصال في حكاياتِ الأحوال مع قيام الاحتمال: يُنَّزل منزلة العموم في المقال)، أما نص الثانية: (وقائع الأعيان، إذا تطرق إليها الاحتمال: كساها ثوب الإجـمال، وسقط بها الاستدلال)، فتناول البحث في شطره الأول القاعدة الأولى؛ فأبان عن لفظها ومعناها وأمثلتها وتناول في شطره الثاني القاعدة الثانية؛ فأبان عنها بمثل ما أبان عن الأولى، ثم انطلق البحث إلى مقصوده الأصيل منه؛ وهو: نقض دعوى تعارض القاعدتين وأنهما صحيحتان عن الإمام الشافعي، ثم بيَّن مسالك العلماء في الجمع بينهما؛ وأن للعلماء أربعة مسالك في الجمع بينهما فذكرها وذكر القائلين بها، وبين وجه الجمع في كل مسلك، وأدلته، والاعتراضات عليه، ثم بيَّن البحث المسلك الراجح في الجمع بين القاعدتين، وأن بين القاعدتين فرقٌا في الحكم؛ حيث إن ألفاظهما بينها أوجه اتفاق، وأوجه افتراق، وأن أوجه الافتراق هي التي توجب تفريقًا في الحكم بينهما، وتقضي بعدم تعارضهما، وأن أولى المسالك في الجمع بينهما: أن تحمل الأولى على حكايا الأحوال التي ترك فيها النبي الاستفصال، وأن تحمل الثانية على حكايا الأحوال التي لم تنقل بالتفصيل؛ وإنما نقلت نقلًا محتملًا لوجوه يختلف الحكم باختلافها؛ فالأولى تُرِك فيها الاستفصال، والثانية لم يترك فيها الاستفصال.  This research explores the approaches scholars have taken to reconcile two principles attributed to Imam Shafi'i, addressing perceived contradictions in their wording. While some suggested conflict, the majority refuted it, offering various methods of reconciliation. The two principles, well-known in Shafi'i jurisprudence, have precise texts indicating their derivation from the Prophet's traditions. The first principle states: "Abandoning detailed specification in narrations of situations while allowing for possibilities lowers the status of generality in discourse." The second principle, regarding factual situations, suggests that when possibilities are considered, it blankets them with the garment of generality, rendering them unsuitable for legal inference. The research delves into the first principle, explaining its wording, meaning, and examples, then moves on to the second principle, providing similar insights. The study's primary objective is to refute claims of contradiction between the two principles, asserting their validity in Imam Shafi'i's teachings. The research then elucidates the various paths scholars have taken to reconcile these principles, presenting four approaches along with proponents, methods, and objections. Finally, the study identifies the predominant approach in harmonizing these principles, emphasizing differences in legal rulings based on specific contexts. The analysis highlights areas of agreement and divergence in the wording of the principles, indicating that divergences necessitate distinct legal judgments, ultimately asserting that the first approach, linking the first principle to situations where the Prophet omitted detailed specifications, while attributing the second principle to situations not conveyed in detail, is the most compelling.
