يستمد هذا البحث أهمية موضوع المسؤولية المدنية لعمليات البنوك الالكترونية من الناحية الاقتصادية فهي من أهم العمليات المصرفية وأبسطها وأقلها تكلفة، حيث تتم عبر آلية سهلة بعيدة عن البيروقراطية المعقدة، إلا أنها تحمل العديد من المخاطر التى تتعلق بالمصالح الاقتصادية للعملاء والبنوك وأحيانا بالاقتصاد الوطني. كما أن المسؤولية المدنية التي تقوم تجاه هذه العملية لم تنظم بقواعد، مما أدى إلى ضرورة البحث في الموضوع لتسهيل المهمة على العملاء في تحصيل التعويضات التي يستحقوها كلما حصل ضرر، وبالتالي خلق عنصر الأمان عند قيام العملاء بنشاطاتهم التجارية منها دون اثقال البنك وعرقلة تقديمه لخدماته المصرفية. واقتراح التوصيات التي تحد من مخاطر العمليات الالكترونية على حسابات المتعاملين مع البنك وآليات التعاطى مع حالات التعدى على الحسابات البنكية باستخدام الوسائل الالكترونية. This research derives the importance of the issue of civil liability for electronic banking operations from an economic point of view, as it is one of the most important, simplest and least expensive banking operations, as it is carried out through an easy mechanism far from complex bureaucracy, but it carries many risks related to the economic interests of customers and banks and sometimes the national economy. In addition, the civil liability towards this process was not regulated by rules, which led to the need to research the subject in order to facilitate the task for customers in collecting the compensation they deserve whenever damage occurs, and thus creating an element of safety when customers carry out their commercial activities without overburdening the bank and hindering its provision of its banking services.. And propose recommendations that reduce the risks of electronic operations on the accounts of customers with the bank and mechanisms to deal with cases of infringement on bank accounts using electronic means.
