تقدمت الحکومة منذ عدة أشهر بمشروع قانون إلى مجلس النواب لتعديل قانون المحکمة الدستورية العليا، ومنحها اختصاصًا جديدًا بالرقابة على دستورية قرارات المنظمات والهيئات الدولية، إضافة إلى أحکام هيئات التحکيم الأجنبية وأحکام المحاکم التابعة للدول الأخرى. وقد تصدينا لهذا المشروع في حينها بمقال نشرناه– استجابة لحالة الاستعجال– على کل مواقع التواصل الاجتماعى بهدف إنقاذ ما يمکن إنقاذه. وقد کان جل مقالنا الترکيز على مخالفة المشروع المنادى به للقوانين والاتفاقيات الدولية المنظمة للتحکيم التجارى الدولى. وبالفعل استجابت الحکومة وطلبت من البرلمان أثناء مناقشة مواد المشروع استبعاد أحکام المحکمين الأجنبية من نطاق تطبيقه، ليصدر القانون في النهاية قاصرًا رقابة المحکمة الدستورية العليا على قرارات المنظمات والهيئات الدولية، إضافة إلى أحکام المحاکم الأجنبية. وهو أيضًا اختصاص محل نظر ومخالف للقانونين الدولى والداخلى. وتدور فکرة المقال حول معالجة هذه المسائل مع التعليق على القانون الجديد بعد صدوره، لننتهي إلى أن الاختصاص الجديد غير قابل للتطبيق بالنسبة لقرارات المنظمات الدولية، لعدم امتلاک البلاد لآليات تنفيذ أحکامها الصادرة في هذا الصدد دوليًا. وغير مفيد بالنسبة لأحکام المحاکم الأجنبية، لأن الاختصاص برقابتها منعقد أساسًا للمحاکم الابتدائية لدى طلب تنفيذها في مصر، ومن ثم يمکن تحقيق ذات الغاية بواسطة رقابة المحاکم الابتدائية. Several months ago, the government submitted a draft law to the House of Representatives to amend the Law of the Supreme Constitutional Court by giving it new jurisdiction to monitor the constitutionality of decisions issued by international organizations and bodies, in addition to the awards issued by foreign arbitral tribunals and the judgments issued by courts of other countries. We criticized this draft law through publishing an article through all social media sites as a matter of urgency. The main idea of our article focused on the draft law violation of the international laws and conventions regulating international commercial arbitration. Indeed, the government responded and asked House of Representatives, during the discussion of the draft law, to exclude the judgments of foreign arbitrators from the scope of its application, so that the law was finally issued, limiting the supervision of the Supreme Constitutional Court to the decisions of international organizations and bodies, in addition to the judgements of foreign courts. This jurisdiction is also questionable and involve a violation of international and domestic law. The idea of the article revolves around addressing these issues with comments on the new law after its issuance. The article concludes that the new jurisdiction cannot apply to the decisions of international organizations because the government does not have the mechanisms to enforce its decisions internationally. The new jurisdiction is also not useful for foreign court judgments because the jurisdiction to monitor such judgment is essentially granted to courts of first instance when the judgment is requested to be enforced in Egypt. Therefore, the same goal is achieved through the monitoring of the courts of first instance.
