أقر المشرّع بوجوب تسبيب القرار الصادر بالعقوبة التأديبية، وهذا الالتزام يعد من أهم الضمانات التي تکفل تحقيق المساءلة التأديبية العادلة، حيث يتمکن صاحب الشأن من معرفة ما انتهت إليه السلطة التأديبية بحقه، وأن مساءلته تقوم على أسباب تبررها، وأن السلطة التأديبية التزمت في خصوصها کافة الاعتبارات القانونية اللازمة، فضلاً عن أنه يساعد القضاء في التحقق من صحة الأسباب التي استندت عليها السلطة التأديبية عند اتخاذ قرارها بالعقوبة التأديبية. وتحقيق الغاية من اعتبار التسبيب أمراً وجوبياً يفرض على السلطة التأديبية التقيد بالضوابط التي يجب مراعاتها لضمان صحة التسبيب ومشروعيته، والتي تؤدي مخالفتها إلى بطلان القرار الصادر بالعقوبة التأديبية. The legislator admitted the obliging of causation the issued decision with punitive punishment. This obligation is considered one of the most important guarantees which ensure the achieving the just punitive questioning that enables the responsible to know the aim of punitive authority towards him and that its questioning depends on reasons that justify it. The punitive authority obliged itself in all the necessary legal considerations rattler than it helps the judge in checking the reasons which the punitive authority depends on when making the decision of punitive punishment. Achieving the aim of considering the causation a positive thing imposes on the punitive authority the obligation of the controls (rules) that should be considered to make sure of the correctness of causation and its legality and when breaking them leads to the nullity of the issued decision with the punitive punishment.
