البحث يتكون من مقدمة، وفصلين، وخاتمة، المقدمة تضمنت مشكلة البحث، وأهمية الموضوع، وأسباب اختياره، والدراسات السابقة، ومنهج البحث، وعملي فيه، والخطة التي انتهجتها في دراسته، وتناولت علاقة العاطفة بأحكام الشريعة، وعلاقتها بالعقل، وأهميتها في تشريع الأحكام، وضوابطها، كما تناولت مدى تأثير العاطفة على الأحكام الشرعية في الفروع الفقهية من مختلف الأبواب الفقهية، فيظهر تأثيرها في أحكام الجنائز، والحضانة، والولاية، والهبات، والوصايا، وفي أحكام الجنايات، والشهادات، والجهاد،  وغيرها من الفروع الفقهية المختلفة، فموضوع البحث موضوع شيق يستثير القارئ الكريم لأن يطالع البحث ويتعرف على ما فيه، كما تناولت فيه حكم القتل بدافع العاطفة المسمى بالموت الرحيم، وإذن الوالدين في الجهاد، وكان من أهم النتائج التي انتهى إليها البحث أنه لابد من التوازن بين العقل والعاطفة؛ حتى تكون الأمور متوازنة، فينبغي ألا تغلب على الفقيه عاطفته عند بيانه للحكم الشرعي، وقد جعل الإسلام حضانة الأطفال للنساء؛ لأن الحضانة مبنية على وفور الشفقة والعطف والرفق بالصغار، وذلك أوفر في جانب النساء .
