الملخص
يتناول البحث بعنوان : مسائل افتراضية في الوقف مستل من رسالة دكتوراه بعنوان الفقه الافتراضي في أحكام المعاملات المالية وأثره في النوازل المعاصرة من خلال كتاب رد المحتار على الدر المختار لابن عابدين الدمشقي الحنفي (المتوفى: 1252هـ). دراسة فقهية مقارنة.
فإن من أعظم القربات نشر الدعوة الإسلامية وبث أحكامها الفقهية وبخاصة ما يتعلق بأحكام المعاملات المالية التي يحتاج الناس إليها ليلًا ونهارً في شتى مناحي الحياة.
منهج البحث:
وقد اقتضت طبيعة البحث أن أستخدم المنهج التحليلي المقارن، وقد اشتمل البحث على تمهيد وبمسألتين وخاتمة:
المسألة الأولى: الوقف على الحمل
المسألة الثانية: تعلق الوقف على شرط
الخاتمة وفيها أهم النتائج والتوصيات، والمراجع
Summary
The research, entitled: Hypothetical Issues in Endowment, is taken from a doctoral dissertation entitled Hypothetical Jurisprudence in the Rulings of Financial Transactions and its Impact on Contemporary Calamities through the book Radd al-Muhtār āl al-Durr al-Mukhtar by Ibn Abidin al-Dimashqi al-Hanafi (deceased: 1252 AH). A comparative jurisprudential study.
One of the greatest blessings is spreading the Islamic call and disseminating its jurisprudential rulings, especially with regard to the rulings on financial transactions that people need day and night in various aspects of life.
Research Methodology:
The nature of the research required that I use the comparative analytical method. The research included an introduction, two questions, and a conclusion:
The first issue: stopping pregnancy
The second issue: The suspension is subject to a condition
The conclusion contains the most important results, recommendations, and references
