تناولت هذه الدراسة مفهوم القواعد الآمرة وأثرها على المعاهدات الدولية، وذلك لما لها من أهمية في تحقيق الأمن والسلم الدوليين، فالمجتمع الدولي ساهم في تأسيس هذه القاعدة حتى تكون قيدا على حرية الدول فلا تستطيع الدول خرقها لارتباطها الوطيد بالنظام العام، وبذلك فهي تسمو على القواعد القانونية ولا تتيح للأفراد الذين يخضعون لأحكامها أن يخالفوا أحكامها، والقواعد الدولية الآمرة لها تأثيرها الملحوظ على المعاهدات الدولية، وعطفًا على ذلك فقد قسمت هذه الدراسة إلى مبحث أول بعنوان التعريف بالقاعدة الآمرة القانون الدولي العام، ومبحث ثاني بعنوان الأثر القانوني للقواعد الآمرة في نطاق قانون المعاهدات الدولية والتي أهدف من خلالها إلى بيان ماهية القواعد الدولية الآمرة  والكشف عن الآثار القانونية للقواعد الآمرة، وتحقيقا لأهداف هذه الدراسة فقد تم اتباع المنهج الوصفي، وقد توصلت الدراسة إلى عدة نتائج أهمها، أنه للمجتمع الدولي الأحقية في إبرام المعاهدات على أن لا تخالف تلك المعاهدة قاعدة آمرة في القانون الدولي، لذا على الدول الأطراف في المعاهدة الدولية الالتزام باحترام القواعد الدولية الآمرة وتنفيذ أحكامها، ولذلك أوصي القضاء الدولي على أن يقوم باتخاذ جميع التدابير التي تكفل بتنفيذ القواعد الدولية الآمرة، ومحاسبة الدول التي تخل بالالتزام بتلك القواعد، فيتم إيقاع الجزاء عليها كمنعها من إنشاء معاهدات دولية جديدة وذلك حتى تلتزم بالقواعد الدولية الآمرة، إلى جانب تعويض الأطراف التي لحقها الضرر.   Abstract:  This study addresses The Concept of Peremptory Norms and Their Impact on International Treaties, given their importance in achieving international peace and security. The international community has contributed to establishing these norms as a restriction on the freedom of states, preventing them from violating such norms due to their strong connection to public order. Consequently, these norms hold a higher status than other legal rules and do not allow individuals subject to their provisions to act contrary to them. Peremptory norms of international law have a significant impact on international treaties. Accordingly, this study is divided into two sections: the first focuses on defining peremptory norms in public international law, while the second examines the legal effects of peremptory norms within the scope of international treaty law. The aim is to clarify the nature of peremptory norms and uncover their legal effects. To achieve the objectives of this study, the descriptive method was employed. The study reached several conclusions, the most important of which is that the international community has the right to conclude treaties, provided that such treaties do not violate a peremptory norm of international law. Therefore, states that are parties to an international treaty must respect and implement peremptory norms. Based on this, I recommend that international courts take all necessary measures to ensure the enforcement of peremptory norms and hold states accountable for violating these norms, including imposing sanctions such as preventing them from concluding new international treaties until they comply with peremptory norms, as well as compensating the harmed parties.
