يتلخص البحث فى التعرف المسؤولية وبيان مفهومها في اللغة والنظام السعودي والفقه الإسلامي ،وبيان تعريف المسؤولية الجزائية في النظام السعودي والفقه الإسلامي، فالمسؤولية بمعناها العام هي الالتزام بتحمل الجزاء الذى ترتبه الأنظمة في حالة إتيان فعل يشكل خرقًا أو مخالفة لأحكامها فالمسؤولية مفهوم يستدل منه على معنى مساءلة، أي قياس نتائج عمل ما، كما أنها تذكر أحيانًا بمعنى الالتزام أو الضمان، والمسؤولية مرتبطة بشكل وثيق بالإنسان، فأي عمل يقوم به الإنسان سواء على المستوى الفردي أو الجماعي تلازمه مسؤولية، وتناولت في البحث أيضا المسؤولية الجنائية للوسيط العقاري فى النظام السعودي والفقه الإسلامي ،وإذا اتخذ الوسيط العقاري موقفًا سلبيًا فأحجم بإرادته الحرة عن الامتناع عن الإفصاح كتابة لأطراف عقد الوساطة العقارية احتمالية وجود تعارض المصالح أو إذا كان وسيطًا للطرفين في آن واحد، أو عدم وضع رقم الترخيص الخاص به في عقد الوساطة، وجميع تعاملاته المتعلقة بممارسة الوساطة العقارية والخدمات العقارية، أو عدم اجتياز البرنامج التأهيلي للوسطاء العقاريين لكل نشاط قبل ممارستهم، أو إذا امتنع الوسيط عن تسجيل جميع عقود الوساطة التي يبرمها "بيع أو شراء أو تأجير العقار أو منفعته" على المنصة الإلكترونية الخاصة بها، فإن موقف الوسيط العقاري هنا موقف سلبي يتم تكييفه بأنه امتناع مقصود، ويمثل العنصر المادي في الامتناع في عملية الإحجام، سواء كان في صورة سلبية أو بالقيام بسلوك مغاير لما يجب عليه اتخاذه من فعل.   Abstract: This research aims to identify the criminal responsibility and the statement of its conceptuality in linguistics and Saudi Regulations and the Islamic Jurisprudence  and the statement of identification of the criminal responsibility of penalties in the Saudi Regulations and the Islamic jurisprudence  , as the identification of responsibility in general is the commitment of bearing penalties that generated by regulations in case of acting in breaching or violations of the rules so the responsibility is a concept of responsibility meaning  in any results of actions as well as it is mentioning sometimes the meaning of commitments or the guarantee of responsibility attached and related tightly with human as any actions performed by human either  individually or in community  sense is related to the responsibility , as I have handled in this research the responsibility criminally of the real estate brokers in Saudi regulations and Islamic Jurisprudence and in the case of that the real estate broker has acting negatively  attitude and he has denied  by his free will to disclose in written manners for any of the  parties in relation to the real estate, with  possibility of contradictory  of interests in the brokers agreement and if he is broker for the both parties or non- mentioning  license number and in all transactions related to the practicing the real estate brokering and other real estate services or unpassed  the qualifications programs of brokering for each activity performed or if he abolished the registration in all brokering agreements that mentioned in the sales or purchases agreements or leasing or its utilities  on the electronic platform as in this case that the attitude of the real estate broker is negative and has been adapted of the intended abolishment as it is considered as materially elements in prohibition either in negative sense or performing and acting in different to what have been properly acted
