تكمن مشكلة البحث أن بعض الإعلانات العقارية كانت وهمية ومصدرا للجرائم كالنصب والاحتيال والاستغلال الوظيفي ومحل نزاعات وقضايا لما فيه من غبن واستغلال للأفراد وضياع لحقوقهم وأموالهم ، وتهدف الدراسة إلى بيان العدالة الوقائية والأمن القانوني والإعلان والتصرف في الأموال العقارية، ومعرفة حال الإعلانات العقارية السابقة وأسبابها، البحث عن الأنظمة بوصفها محال للعدالة الوقائية عند الإعلان عن التصرف في الأموال العقارية في المملكة العربية السعودية مع تتبع آثارها، والمنهج المتبع في البحث المنهج الوصفي المبني على الاستقراء والتحليل والاستنتاج للأنظمة السعودية ذات الاختصاص بالإعلان العقاري سواء لعقارات الدولة أو العقارات الخاصة، ومن أهم النتائج أنها أدت إلى حوكمة الإعلانات العقارية سواء المتعلقة بعقارات الدولة أو العقارات الخاصة، من حيث المعلن ومحتوى الإعلان ووسيلة الإعلان وتحديد أهداف الإعلان والمرخص لهم بالإعلان واستخدام الوسائل الإليكترونية للإعلان والذي كان له الأثر المباشر في تعزيز الشفافية والموثوقية في السوق العقاري السعودي، ففي عقارات الدولة أدت إلى تعزيز عدالة التقديم والمنافسة وتكافؤ الفرص والحد من استغلال النفوذ وتعارض المصالح وتحقيق العائد المالي الأفضل للمنافسات، وفي العقارات الخاصة الحد من الإعلانات الوهمية وجرائم النصب والاحتيال ومنع غير المرخص لهم من استغلال السوق العقاري مما كان الأثر الإيجابي المباشر في انتعاش حجم التداولات العقارية وزيادتها، ومن أهم التوصيات تعزيز الرقابة والتفتيش على الإعلانات غير النظامية سواء التقليدية أو في وسائل التواصل الاجتماعي بواسطة استخدام أمثل للتقنيات العقارية والمسح الإليكتروني.
Abstract:
The research problem lies in the fact that some real estate advertisements were fraudulent and became sources of crimes such as fraud, deception, abuse of authority, and were often the subject of disputes and litigation due to exploitation and the loss of individuals' rights and assets. The study aims to clarify the concept of preventive justice, legal security, advertising, and transactions in real estate assets, as well as to examine the state and causes of previous real estate advertisements. It further seeks to analyze the implications and effects of preventive justice when announcing real estate transactions in the Kingdom of Saudi Arabia. The study adopts a descriptive methodology based on induction, analysis, and inference of Saudi regulations related to real estate advertisement, whether for state-owned or private properties.One of the key findings is that real estate advertisement governance has been achieved for both state-owned and private properties. This includes regulating the advertisers, the content of the advertisements, the means of publication, defining the objectives of the advertisements, specifying the authorized advertisers, and utilizing electronic advertising platforms. These measures have directly enhanced transparency and trustworthiness in the Saudi real estate market. For state-owned properties, they have promoted fairness in submissions, competition, equal opportunities, reduced abuse of power and conflicts of interest, and achieved better financial returns from competitions. For private properties, the measures have reduced fraudulent advertisements and crimes, prevented unauthorized individuals from exploiting the real estate market, and positively impacted the growth and activity of real estate transactions. Among the key recommendations is the need to strengthen monitoring and inspection of irregular advertisements, whether traditional or on social media platforms.
