عنوان البحث: أحكام المخدرات في الفقه والقانون. المنهج المتبع: هو المنهج التحليلي الوصفي. خلصت الدراسة إلى أن المخدرات هي ما يغيب العقل دون الحواس مع نشوة وطرب وشدة وقوة، وفيها مضرة من السموم، مثل: ورق القتب والسكيران والأفيون والبنج والبرش وجوزة الطيب والداطورة. وهي محرمة شرعاً، وقانوناً، لا يجوز تعاطيها والتجارة فيها. ويجوز التداوي ببعض المخدرات كالبنج مثلا في حالة الضرورة بواسطة الطبيب المختص. والمخدرات لها أضرار دينية وصحية ونفسية واجتماعية واقتصادية وأمنية. وهنالك أسباب أدت إلى تعاطي المخدرات منها أسباب شخصية وتتمثل في ضعف الوازع الديني والفراغ والتقليد والمجاملة وغيرها، وهنالك أسباب اجتماعية منها: التفكك الأسري ورفقة السوء والسفر للخارج، وهنالك أسباب اقتصادية منها: الفقر وسوء الأحوال المادية والغنى والترف، وهناك أسباب صحية منها: اعتلال الصحة البدنية واعتلال الصحة النفسية، وهناك أسباب سياسية منها: انتشار المخدرات عن طريق المستعمر. والمخدرات عقوبتها تعزيرية بحسب حال الجاني من تعاط أو ترويج أو تجارة أو مشاركة في بيعها وترويجها. وعقوبتها في القانون قد تصل للقتل أو السجن أو الغرامة بحسب الحال. أوصت الدراسة بالآتي: ـ غرس القيم الدينية لدى الشباب حتى يكون لهم حصناً واقياً من الوقوع في فخ المخدرات. ـ قيام منظمة تعنى بمكافحة المخدرات وذلك عن طريق التوعية الصحية وعقد الورش والمؤتمرات والندوات وعبر أجهزة الإعلام. ـ على الأسر المسلمة متابعة أبنائها وبناتها، وحفظهم من قرناء السوء ومن الإعلام الهدام. ـ نوصي القائمين على أجهزة الإعلام أن يصمموا برامج هادفة في التحذير من المخدرات وأضرارها. ـ نوصي القائمين على الأجهزة الأمنية والشرطية إحكام القبضة على المتمردين على الشرع والقانون والمروجين لتجارة المخدرات وإيقاع العقوبة الرادعة بهم.   Abstract: The study showed that drugs are what absent the mind without the senses with ecstasy, joy, intensity and strength, it is harmful to toxins, such as: hemp – plant, drunks, opium, henbanes, rivet, and nutmeg – spice, as well as datura. Any lawful or legally prohibited person shall not be subjected to abuse or commerce therein, some drugs, such as henbanes, may be administered if necessary by the competent physician. Drugs have religious, health, psychological, social, economic, and security damage. There are reasons that have led to drug use, including personal reasons, namely the weakness of religious conscience, emptiness, compliment, etc. Additionally, there are social reasons, including family disintegration, bad company and travel abroad. There are economic reasons, including poverty, poor material conditions, wealth and luxury. Moreover, there are health reasons, including physical ill-health and mental ill-health. Narcotic drugs are punishable under the offender's condition of abuse, promotion, trade or participation in the sale and promotion of drugs, and her punishment in law may amount to murder, imprisonment or a fine as the case may be. Recommendations: - Instilling religious values in young people so that they have a protective bulwark against falling into the drug trap. - Establishing anti-Drug Organization through Health Awareness and holding workshops, conferences, symposiums, as well as through motivating the role of the media. - Muslim families must follow their sons and daughters and banned them from the bad and destructive media. - We recommend the media to design targeted programs in drug warning and damage. - We also recommend that security and police agencies to tighten the grip on the rebels on the Shara'a and the law in addition to drug traffickers and their deterrent punishment.
