تهدف هذه الدراسة إلى إبراز عناية الشريعة الإسلامية الغراء البالغة بأمر الوزن، والتأكيد على الوفاء به تأكيداً كبيراً من خلال الآيات القرآنية والأحاديث النبوية الشريفة، والتهديد والوعيد الشديدين لمن طفَّف فيه، وبيان عقوبة المطففين كما دلَّتْ عليها آيات القرآن الكريم وأحاديث النبي صلى الله عليه وسلم، والتأكيد على أن أمر الميزان عظيم؛ لأن مدار معاملات الخلق عليه، ولأن هناك كثير من العبادات المهمة التي تتوقف على دقة الوزن ؛ كالزكاة مثلاً، لذا حرصت في هذا البحث على جمع كل الموازين التي ذكرت في أحاديث النبي صلى الله عليه وسلم، (والتعريف بها)، وبيان تقديرها عند العلماء قديماً وحديثاً؛ حتى يؤدي المسلم كل ما عليه من تكليفات وواجبات شرعية بدقَّة تامة، وقد اتبعت في هذه الدراسة (المنهج الاستقرائي التحليلي)؛ حيث إن حصر الموازين يتطلب تتبع الأحاديث الواردة في هذا الجانب من كتب السنة النبوية، ثم التركيز على الشاهد منها – وهو الموازين - ودراسته وفق ما قاله العلماء، وكل ذلك في هيئة دراسة حديثية موضوعية.
وقد خلصت الدراسة إلى: اهتمام الشريعة الإسلامية بأمر الوزن، والتأكيد على إيفائه، والوعيد لمن طفَّف فيه، وإبراز الفرق بين الكيل والوزن؛ فالكيل يوضح حجم السلع، أما الوزن فيوضح ثقل السلع، كما خلصت الدراسة إلى أن الموازين قد اكتسبت صفة الشرعية لأنها صدرت مِمَّنْ له الأمر والنهي وهو النبي صلى الله عليه وسلم، ومن ثمَّ فلا يجوز تغييرها لا بالزيادة عليها ولا بالنقصان منها، ومن ثمَّ تمَّ جمْع هذه الموازين – على اختلاف أنواعها - التي ذكرت في الأحاديث المرفوعة، وبيان تقديرها عند العلماء، وقد خرجت هذه الدراسة في مقدمة، وتمهيد، ومبحثين رئيسين، واندرج تحت كل مبحث ما يناسبه من المطالب.
Research Summary:
This study aims to highlight the great concern of Islamic law with the matter of weight, and the great emphasis it places on adhering to it through Quranic verses and Prophetic hadiths. It also highlights the severe threats and warnings against those who cheat, and explains the punishment of those who cheat, as indicated by the verses of the Holy Quran and the hadiths of the Prophet (peace and blessings be upon him). It also emphasizes the importance of the scale, as it is the basis of human transactions, and because many important acts of worship depend on the accuracy of weight, such as zakat, for example. Therefore, in this study, I have taken care to collect all the scales mentioned in the hadiths of the Prophet (peace and blessings be upon him), define these scales, and explain their estimation by scholars, both ancient and modern. In order for a Muslim to fulfill all his religious obligations and duties with complete precision, I followed an inductive and analytical approach in this study. Identifying the scales requires tracing the hadiths related to this aspect of the Prophetic Sunnah, then focusing on the most relevant evidence—the scales—and studying it according to the scholars' opinions. All of this is done in the form of an objective hadith study. The study concluded that: Islamic law emphasizes the importance of weight, emphasizes its fulfillment, imposes a warning on those who cheat, and highlights the difference between measure and weight. Measurement indicates the volume of goods, while weight indicates their weight. The study concluded that scales have acquired a legitimate status because they were issued by the One who has the authority to command and forbid, namely the Prophet (peace and blessings be upon him). Therefore, it is impermissible to alter them, neither by adding to them nor subtracting from them. Therefore, these scales—of various types—mentioned in the authentic hadiths were collected, and their evaluation by scholars was explained. This study consists of an introduction, a preface, and two main chapters, each with its own set of topics.
