هذا البحث يبين أهمية معرفة الأمر المتهايأ عليه، وتكون بقسمة المنافع على التعاقب والتناوب، وتكون المهايأة فى الزمان أو المكان، ففى الزمان كما لو تهايأ شخصان على زراعة الأرض المشتركة على أن يزرعها هذا سنة ويزرعها الآخر سنة، أما المكان كما لو تهايأ شخصان فى الأرض المشتركة بينهما على أن يزرع الأول النصف والثانى النصف الآخر، ويقع هذا أيضًا فى الدور المشتركة بأن يسكن أحدهما فى طرف والآخر فى طرف أو فى دارين مشتركتين فيسكن أحدهما فى واحدة والآخر فى الأخرى.
هذا ويتناول البحث رأى القانون المدنى مع عقد المقارنة بين الفقه الإسلامى والقانون المدنى
This research shows the importance of knowing the matter that is settled on it and it is by dividing the benefits according to succession and rotation, and the arrangement is in time or place shared between them, provided that the first cultivates one half and the second the other half and this also occurs in shared homes where one of them lives on one side and the other on other side or in two joint homes, so that, one of them lives in one and the other in the other.
This research deals with the view of civil law with a comparison between Islamic jurisprudence and civil law.
