يهدف هذا البحث إلى دراسة تأثير الحرب الدائرة في السودان على عقود الإيجار، وتحليل الإشكالات القانونية التي نشأت بسبب تعذر تنفيذ الالتزامات التعاقدية بين المؤجرين والمستأجرين يناقش البحث مدى إمكانية تطبيق نظريتي القوة القاهرة والظروف الطارئة على هذه العقود، كما يستعرض موقف القضاء السوداني والتشريعات ذات الصلة، مع إجراء مقارنة قانونية مع أنظمة دولية أخرى مثل فرنسا، مصر، والولايات المتحدة الأمريكية، خلصت الدراسة إلى أن الحرب أدت إلى فقدان المستأجرين للقدرة على سداد الإيجار أو الانتفاع بالعقارات، في حين تكبد المؤجرون خسائر مالية نتيجة تعثر التحصيل، مما أفرز العديد من النزاعات القانونية، كما تبين أن التشريعات السودانية الحالية لا توفر حلولًا كافية لمعالجة هذه الحالات الاستثنائية، حيث تفتقر إلى نصوص واضحة تنظم عقود الإيجار في حالات الحرب، بناءً على النتائج، يقترح البحث تعديلات تشريعية تتضمن إصدار قوانين استثنائية لتعليق أو تخفيض الإيجار في المناطق المتأثرة بالحرب، وتعزيز دور القضاء في تعديل العقود بدلًا من فسخها، إضافة إلى تفعيل آليات التحكيم والوساطة لحل النزاعات بشكل أكثر مرونة. كما يوصي بالاستفادة من التجارب الدولية الناجحة لضمان حماية حقوق الأطراف المتعاقدة وتحقيق التوازن بين مصالح المؤجرين والمستأجرين خلال الأزمات. This study aims to examine the impact of the ongoing war in Sudan on lease contracts and analyze the legal challenges that have arisen due to the inability of landlords and tenants to fulfill contractual obligations. The research explores the applicability of the doctrines of force majeure and unforeseen circumstances to these contracts. It also reviews the stance of Sudanese judiciary and relevant legislation, with a comparative legal analysis of international systems such as those of France, Egypt, and the United States. The study concludes that the war has resulted in tenants losing their ability to pay rent or utilize leased properties, while landlords have suffered financial losses due to payment defaults, leading to numerous legal disputes. Additionally, it finds that current Sudanese legislation does not provide adequate solutions for such exceptional cases, as it lacks clear provisions governing lease contracts during wartime. Based on these findings, the research proposes legislative amendments, including the issuance of exceptional laws to suspend or reduce rent in war-affected areas, enhancing judicial authority to modify contracts rather than terminate them, and activating arbitration and mediation mechanisms for more flexible dispute resolution. The study also recommends leveraging successful international experiences to ensure the protection of contracting parties' rights and achieving a balance between landlords' and tenants' interests during crises.
