يهدف هذا البحث إلى دراسة جزئيَّة من جزئيَّات حمل المطلق على المقيَّد، وهي: "حمل المطلق على المقيَّد في حالتي النَّفي والنَّهي"، وذلك لإظهار النُّصوص الأصوليَّة التي أكَّدت على التَّفريق في حمل المطلق على المقيَّد بين حالة الإثبات وحالة النَّفي أو النَّهي ، حيث أغفل بعض الأصوليين بيان الفرق بين الحالتين، أو نصَّ على التَّسوية بينهما، فأردت تجلية هذه الجزئيَّة بضبط المسألة، وتحرير ما نقل فيها من أقوال، مع بيان سبب الخلاف، وبيان أثر ذلك في الأحكام الفقهيَّة من خلال مبحث التَّطبيقات. واتَّبعت منهج الاستقراء مع الاستنباط. وكان من نتائج البحث: عدم التَّسوية في حالات الحمل بين الإثبات والنَّفي أو النَّهي عند كثير من الأصوليين من حيث الحكم والدَّليل، واعتبار حالة النَّفي أو النَّهي من قبيل العام والخاص لا من قبيل المطلق والمقيَّد. وبناء عليه: ذهب كثير من الأصوليين إلى أنَّه إذا كان المطلق والمقيَّد نفياً أو نهياً، فلا يحمل المطلق على المقيَّد في جميع حالاته. والأظهر من خلال المقارنة بين أقوال الأصوليين وأدلتهم: أنَّ المطلق والمقيَّد إذا كانا نفيين أو نهيين، واتَّحد الحكم والسَّبب، فإنَّه يحمل المطلق على المقيَّد إذا كان للقيد مفهوم مخالف معتد به. وأمَّا إذا لم يكن له مفهوم يعتدُّ به فلا حمل. وإذا اتَّحد الحكم واختلف السَّبب، فيحمل المطلق على المقيَّد في حالتي النَّفي والنَّهي من جهة القياس، فإن لم يكن قياس فلا حمل. وفي حالة اختلاف الحكم لا يحمل المطلق على المقيَّد مطلقاً سواء اتَّحد السَّبب أو اختلف.   Abstract: This research aims to study a partial of the parts of carrying the absolute on the restricted, namely: "carrying the absolute on the restricted in the cases of negation and prohibition", in order to show the fundamentalist texts that emphasized the differentiation in carrying the absolute on the restricted between the state of proof and the state of negation or prohibition, where some fundamentalists omitted to explain the difference between the two cases, or provide for the settlement between them, I wanted to manifest this part by adjusting the issue, and editing the quoted sayings, with a statement of the reason for the dispute, and the statement of the impact of that In jurisprudential rulings through the subject of applications. And followed the method of induction with deduction.  Among its results: the lack of compromise in cases of pregnancy between affirmation, negation or prohibition according to many fundamentalists in terms of ruling and evidence. In addition, they are considering the case of the negation and prohibition cases as general and specific, not as the absolute and restricted. Accordingly, many of the fundamentalists advised that if the absolute and the restricted are negated or prohibited. The absolute does not apply to the restricted in all cases. So, it is clearest from a comparison between the fundamentalists statements and their evidence are: if the absolute and the restrictive are both negations or prohibitions, and the ruling and the reason are united, then the absolute applies to the restrictive if the restriction has a different and valid concept. But if it does not have a reliable concept, then there is no pregnancy. If the ruling is unified and the reason differs, then the absolute burden is imposed on the restricted one in terms of analogy.
