يتناول هذا البحث تحليلًا قانونيا للنصوص القانونية والأحكام القضائية في النظام السعودي المتعلقة بتخلف تحصيل الاعتماد المالي في العقود الإدارية، مع التركيز على أثر تخلفه بوصفه عيبًا إجرائيًّا وشكليًّا، وأثر تخلفه على الالتزامات الناشئة عن العقد الإداري. وتوضيح مدى كونه من قبيل عيب تخلف الشكل والإجراء الجوهري وغير الجوهري في العقد الإداري، ومدى تأثيرها على صحة العقود الإدارية، وأثرها على حقوق المتعاقد. فالبحث يدرس التباين الظاهري بين النصوص القانونية والتطبيق العملي للمحاكم بشأن تخلف الاعتماد المالي ومحاولة الجمع بينها ووضع خط ناظم لمسائلها، حيث يتجلى أثر البحث في تحديد الأحوال التي يمكن فيها تصحيح العقد والإجراء كحالة التنفيذ الجزئي والكامل للعقد، والأحوال التي يترتب عليها بطلان العقد مطلقا.      Abstract: This research provides a legal analysis of the legislative texts and judicial rulings in the Saudi legal system concerning the failure to secure financial allocations in administrative contracts. It focuses on the impact of such failure as a procedural and formal defect and its effect on the obligations arising from administrative contracts. The study examines whether this failure constitutes a fundamental or non-fundamental procedural defect in administrative contracts and assesses its implications for the validity of such contracts and the rights of contracting parties. The research also explores the apparent discrepancy between legal provisions and judicial practice regarding the failure to secure financial allocations. It aims to reconcile these differences and establish a guiding framework for addressing such issues. The study highlights the conditions under which contracts and procedures can be rectified—such as in cases of partial or full contract execution—as well as situations where absolute nullity applies.
