حماية البيئة في القانون الدولي والأنظمة المحلية من الأولويات التي عنيت بها المملكة العربية السعودية، لذلك بادر ولي العهد السعودي صاحب السمو الملكي الأمير محمد بن سلمان إلى الإعلان عن مبادرتي السعودية الخضراء والشرق الأوسط الأخضر وذلك عام 2021م وأنشأ عدداً من المحميات الملكية وذلك لرفع مستوى الغطاء النباتي على الأرض، ومعالجة التلوث البيئي، وقد صدر نظام البيئة في المملكة العربية السعودية عام 1441هـ حيث ألغى هذا النظام جميع الأنظمة الصادرة والتي تتعلق بالبيئة ليتوافق هذا النظام مع القانون البيئي الدولي العالمي الصادر عن الأمم المتحدة والذي يضم عدداً من الاتفاقيات والقوانين العالمية والتي سنذكر عدداً منها في ثنايا هذا البحث، لذلك جاءت فكرة هذا البحث والتي هي بعنوان:(حماية البيئة في النظام السعودي دراسة مقارنة بالقانون الدولي)، والقانون الدولي البيئي هو عبارة عن مجموعة القواعد القانونية الدولية والعرفية والاتفاقيات المتفق عليها بين الدول للمحافظة على البيئة من التلوث، ويعد مؤتمر استوكهولم والمنعقد عام 1972م نقطة تنسيق وانطلاق في مجال الأنظمة والقوانين الدولية في ميدان حماية البيئة فقد أنشئ بعده برنامج الأمم المتحدة للبيئة. وألزم النظام البيئي السعودي كل من يمارس أيًّا من الأنشطة البيئية أو التي لها أثر بيئي، تصحيح أوضاعه بما يتوافق مع أحكام نظام البيئة ولوائحه، وهذا النظام من الأنظمة المستمدة من توجيهات الدين الإسلامي الذي حث على ضرورة المحافظة على البيئة والمراد بحماية البيئة في النظام يشمل منع التلوث، والتخفيف من حدته، والحد من تدهور البيئة، وضمان تحقيق التنمية المستدامة؛ وذلك من خلال الالتزام بالمقاييس والمعايير والإجراءات الوقائية أو العلاجية المتعلقة بالبيئة وفقاً لأحكام النظام واللوائح وقد اهتم العالم أجمع بمعالجة مشكلات البيئة عبر الأنظمة الدولية، ويتمثل القانون الدولي البيئي في توفير الحماية البيئية ومنع تلوث المياه البحرية والاستخدام الأمثل للثروات البحرية وحماية المحيط الجوي من التلوث وحماية الغطاء النباتي والحيوانات البرية وحماية البيئة من التلوث، تعد من أهم التحديات في القرن الواحد والعشرين، والدول والمؤسسات تسعى إلى حماية البيئة وتحقيق التوازن بين النمو الاقتصادي، ويبرز ذلك في التشريعات والأنظمة التي تهدف إلى تقليل الأضرار البيئية الناتجة عن الأنشطة البشرية وحماية الموارد الطبيعية، والمملكة العربية السعودية، وضعت إطاراً قانونياً لحماية البيئة يتماشى مع رؤية المملكة 2030 وهذه الدراسة تهدف إلى مقارنة النظام السعودي لحماية البيئة مع بعض الأنظمة العالمية.. Environmental protection in international law and local systems is one of the priorities that the Kingdom of Saudi Arabia has taken care of. Therefore, the Saudi Crown Prince, His Royal Highness Prince Mohammed bin Salman, took the initiative to announce the Green Saudi Arabia and Green Middle East initiatives in 2021 AD and established a number of royal reserves to raise the level of vegetation cover on the ground and address environmental pollution. The Environmental System in the Kingdom of Saudi Arabia was issued in 1441 AH, where this system canceled all issued regulations related to the environment so that this system is consistent with the international environmental law issued by the United Nations, which includes a number of international agreements and laws, some of which we will mention in the folds of this research. Therefore, the idea of ​​this research came, which is entitled: (Environmental Protection in the Saudi System, a Comparative Study with International Law), and international environmental law is a set of international and customary legal rules and agreements agreed upon between countries to protect the environment from pollution. The Stockholm Conference, held in 1972 AD was a coordination and starting point in the field of international systems and laws in the field of environmental protection. The United Nations Environment Program was established after it. The Saudi environmental system obligated anyone who practices any environmental activity or has an environmental impact to correct their situation in accordance with the provisions of the environmental system and its regulations. This system is one of the systems derived from the directives of the Islamic religion, which urged the necessity of preserving the environment. What is meant by environmental protection in the system includes preventing pollution, mitigating its severity, limiting environmental degradation, and ensuring the achievement of sustainable development. This is done by adhering to the standards, criteria, and preventive or therapeutic procedures related to the environment in accordance with the provisions of the system and regulations. The whole world has been interested in addressing environmental problems through international systems. International environmental law is represented in providing environmental protection, preventing pollution of marine waters, optimal use of marine resources, protecting the atmosphere from pollution, protecting vegetation and wildlife, and protecting the environment from pollution. These are among the most important challenges in the twenty-first century. Countries and institutions seek to protect the environment and achieve a balance between economic growth. This is evident in the legislation and regulations that aim to reduce environmental damage resulting from human activities and protect natural resources. The Kingdom of Saudi Arabia has established a legal framework for environmental protection in line with the Kingdom's Vision 2030. This study aims to compare the Saudi environmental protection system with some global systems.
