ملخص البحث الإبادة الجماعية هي أحد أخطر الجرائم الدولية التي تمس الانسانية كلها, وقد وقعت ويلات يندى لها جبين البشرية ابان الحرب العالمية الثانية أصابت شعوب اوربا الشرقية على يد المانيا النازية كان ابرزها ما تعرض له يهود اوربا من تنكيل وتشريد, ما جعل العالم يتضامن مع ضحايا هذه المحرقة وكانت محاكمات نورنبيرغ وطوكيو لعقاب مجرمي الحرب الالمان واليابانيون الذين ارتكبوا المجازر بحق شعوب اسيا, ثم كانت اتفاقية الامم المتحدة لمنع الابادة الجماعية والمعاقبة عليها 1948 ثم نظام روما الاساسي 1998م واللذان شكلا تشريعا متكاملا لمنع الابادة الجماعية والمعاقبة عليها. وما لبث الزمان أن دار دورته وجاءت الجماعات اليهودية لاحتلال ارض فلسطين واقتلاع شعبها منها بالقوة وشهد العالم فصولا متطاولة من التنكيل والقتل والتهجير قامت بها العصابات الصهيونية ثم الجيش الاسرائيلي ضد ابناء الشعب الفلسطيني منذ 1948م ثم  كان اخرها في غزة والتي تجري وقائعها الدامية منذ 7 اكتوبر 2023م وحتى كتابة هذه السطور. واذا بإسرائيل تتنكر لالتزاماتها الدولية بموجب اتفاقية منع الابادة الجماعية 1948 التي وقعت وصدقت عليها وتفعل بالشعب الفلسطيني اضعاف ما تعرضت له على يد المانيا النازية, على مرأى ومسمع من العالم الذي شاهد بالصوت والصورة الابادة الجماعية التي ترتكبها اسرائيل في غزة والتي خلفت حتى الان ما يزيد عن أربعين ألف شهيد وأكثر من مائة الف جريح وتدمير كامل للاعيان المدنية والتي لا غنى عنها لبقاء السكان بل وتجويع وحصار ومنع للمساعدات وقصفها اذا دخلت. وإن كان من ضوء في آخر النفق لوقف هذه الحرب ومعاقبة مجرمي الحرب الاسرائيليين على جرائمهم فإنه دعوى جنوب افريقيا ضد اسرائيل في محمة العدل الدولية كذلك تحرك المدعي العام للمحكمة الجنائية الدولية وطلبه من الدائرة التمهيدية بالمحكمة اصدار مذكرات للقبض على رئيس وزراء اسرائيل ووزير دفاعه, لكن التحدي الاكبر أمام الدول العربية والاسلامية واحرار العالم المساندين للحق الفلسطيني هو تجاوز الفيتو الامريكي والضغط على الولايات المتحدة الامريكية كي ترفع حمايتها عن اسرائيل حتى تتحقق العدالة الدولية . Abstract: Genocide is one of the most serious international crimes affecting all of humanity. The calamities that made humanity blush during World War II afflicted the peoples of Eastern Europe at the hands of Nazi Germany, the most prominent of which was the persecution and displacement suffered by the Jews of Europe, which made the world stand in solidarity with the victims of this holocaust. There were the Nuremberg and Tokyo trials to punish the German and Japanese war criminals who committed massacres against the peoples of Asia. Then came the United Nations Convention on the Prevention and Punishment of Genocide in 1948 and then the Rome Statute in 1998, which constituted a comprehensive legislation to prevent and punish genocide. Time did not take long to turn and the Jewish groups came to occupy the land of Palestine and uproot its people from it by force. The world witnessed long chapters of abuse, killing and displacement carried out by the Zionist gangs and then the Israeli army against the sons of the Palestinian people since 1948 AD. The last of these was in Gaza, whose bloody events have been taking place since October 7, 2023 AD until the writing of these lines. Then Israel renounced its international obligations under the 1948 Genocide Convention, which it signed and ratified, and did to the Palestinian people many times what it was subjected to at the hands of Nazi Germany, in full view of the world that witnessed with sound and image the genocide committed by Israel in Gaza, which has so far left more than forty thousand martyrs and more than one hundred thousand wounded and the complete destruction of civilian objects that are indispensable for the survival of the population, and even starvation, siege, prevention of aid and bombing it if it enters. If there is a light at the end of the tunnel to stop this war and punish Israeli war criminals for their crimes, it is the lawsuit filed by South Africa against Israel in the International Court of Justice, as well as the move by the Prosecutor General of the International Criminal Court and his request to the Pre-Trial Chamber of the Court to issue arrest warrants for the Israeli Prime Minister and his Minister of Defense. However, the biggest challenge facing the Arab and Islamic countries and the free people of the world who support the Palestinian cause is to overcome the American veto and pressure the United States of America to lift its protection of Israel so that international justice can be achieved
