ملخص البحث
هذا البحث مستوحى من كتاب: (المقارنات التشريعية بين القوانين الوضعية المدنية والتشريع الإسلامي، مقارنة بين فقه القانون الفرنسي ومذهب المالكية) تأليف سيد عبدالله علي حسين؛ حيث إن مؤلفه رحمه الله قام بجهد عظيم في ترجمة القانون الفرسي مع مقارنته بالتشريع الإسلامي من خلال المذهب المالكي من خلال ترتيب وتصنيف بديع، فأضاف البحث هنا بيان رأي المذاهب الثلاثة: الحنفية والشافعية والحنابلة وبعض فقهاء الشريعة الإسلامية، كما أنه أضاف إلى ذلك المقارنة بين مواد القانون الفرنسي نسخة 1922م و مواد القانون الفرنسي المعدل بموجب الأمر رقم 131- 2016 والمؤرّخ في 10 فبراير 2016م. وابتدأ البحث مادة المقارنة من البند (160) في تلاشي الالتزامات وانتهاء بالبند  (172) في ترك المدين أملاكه لدائنه كما أنه اشتمل على التعريف ببعض المصطلحات المهمة والواردة فيه. واختتم البحث بأهم النتائج والتوصيات ومنها: ظهور مدى التشابه الكبير بين التشريع الإسلامي وما ورد من بنود القانون الفرنسي في تسديد الديون والالتزامات المتعلقة بالذمة، مما يؤكد مدى استفادة القانون الفرنسي من المذهب المالكي والتشريع الإسلامي العظيم، وظهور سمو التشريع الإسلامي في بعض المقارنات ، وذلك راجع في الأصل إلى أن الشريعة الإسلامية ترتكز في المعاملات على قواعد متينة لكونها ربانية المصدر ، كما أبرز البحث محاسن التشريع الإسلامي وقوتها، وجهود فقهاء الأمة في تقصي المسائل ومعرفة أحكامها.
Abstract:
      This research is inspired by the book, "Comparative Legislation Between Civil Positive Laws and Islamic Legislation: A Comparison Between French Legal Jurisprudence and the Maliki Madhhab," authored by Sayed Abdullah Ali Hussein. The author, may God have mercy on him, made a significant contribution by translating French law and comparing it to Islamic legislation through the lens of the Maliki Madhhab, employing an innovative arrangement and classification. Building upon this foundation, this research presents the opinions of the three major Sunni schools of Islamic jurisprudence: Hanafi, Shafi'i, and Hanbali, as well as the views of other Islamic jurists. Additionally, it compares the provisions of the French Civil Code of 1922 with those of the amended code under Decree No. 131-2016 of February 10, 2016. The comparative analysis begins with Article 160 on the extinction of obligations and concludes with Article 172 concerning the debtor leaving their property to the creditor. The research also includes definitions of key terms. The research concludes with important findings and recommendations. Notably, it reveals a significant degree of similarity between Islamic legislation and the provisions of the French Civil Code regarding the settlement of debts and obligations, affirming the extent to which French law has drawn upon the Maliki Madhhab and the broader Islamic legal system. The research further highlights the nobility and superiority of Islamic legislation in certain comparisons, rooted in the fact that Islamic law is based on solid principles derived from divine revelation. This study underscores the merits and strength of Islamic legislation, as well as the efforts of Islamic jurists in investigating legal issues and determining their rulings.
