يعد موضوع ولاية العهد في الفقه الإسلامي من أهم المستجدات التي طرأت على الفكر السياسي الإسلامي والتي كانت لها مبرراتها، نتيجة اتساع حدود الدولة الإسلامية في عصر الدولة الأموية، ويمكن القول بأن نظام ولاية العهد من الموضوعات المتجددة والتي تحتاج إلى البحث والتحليل، فموضوع ولاية العهد يعالج أهم القضايا التي تهم جميع المسلمين اليوم سواء كانوا حكاما أو محكومين، ويحقق تطبيق نظام ولاية العهد الاستقرار السياسي والسلام الاجتماعي في العالم الإسلامي المعاصر، وبتطبيقها يمكن الحد من ظاهرة الانقلابات العسكرية والتمرد على السلطة السياسية وكذلك الحد من ظاهرة الاستبداد السياسي .  وتطبق بعض الدول الإسلامية والعربية نظام ولاية العهد، منها المملكة العربية السعودية وسلطنة عمان، حيث صدر نظام هيئة البيعة في المملكة العربية السعودية الصادر بالأمر الملكي ( أ / 135) في 26/9/ 1427 هـ الذي ينظم كيفية اختيار ولي العهد السعودي، كما صدر النظام الأساس للدولة في سلطنة عمان رقم 6/2021 والذي يتضمن لأول مرة تنظيم مسألة ولاية العهد في سلطنة عمان، وهو ما يدعونا لنتناول ولاية العهد في الفقه الإسلامي، وكذلك في كل من السعودية وسلطنة عمان.   Abstract: The topic of the Crown Prince in Islamic jurisprudence is considered one of the most significant developments that have emerged in Islamic political thought, which had its justifications, as a result of the expansion of the borders of the Islamic State in the era of the Umayya state we can be said that the system of the Crown Prince is one of the recurring topics is one of the renewable topics that need research and analysis the mandate of the covenant addresses the most important issues of concern to all Muslims today, whether they are rulers or governed. the application of the mandate of the covenant system achieves political stability and social peace in the contemporary Islamic world. by applying it, it is possible to reduce the phenomenon of military coups and rebellion against political power, as well as reduce the phenomenon of political  tyranny.  Some Islamic and Arab countries apply the covenant guardianship system, including the kingdom of Saudi Arabia and the Sultanate of Oman, where the law of the allegiance commission was issued in the kingdom of Saudi Arabia issued by royal order (a /135) on 26/9/1427 ah, which regulates how to choose the Saudi crown prince, as well as the issuance of the state statute in the Sultanate of Oman No. 6/2021, which includes for the first time regulating the issue of the crown jurisdiction in the Sultanate of Oman, which invites us to address the crown jurisdiction in Islamic jurisprudence, as well as in both Saudi Arabia and the Sultanate of Oman.
