تناولت في البحث قضية المخارج الشرعية لإسقاط العقوبة الحدية واستبدالها بالعقوبة التعزيرية في الفقه الإسلامي دراسة فقهية مقارنة. وقد جاء هذا البحث علي النحو التالي: مفهوم مصطلحات البحث: المخارج الشرعية- الإسقاط – العقوبة- الحد – التعزير، وأنواع العقوبات في الفقه الإسلامي، الفرق بين العقوبة الحدية والعقوبة التعزيرية ، الحدود والمبادئ العامة في تطبيقها، والمخارج الفقهية لإسقاطها، أنواع الحدود والحكمة من مشروعيتها، الحدود المتفق عليها، الحدود المختلف فيها، المبادئ العامة في تطبيق الحدود: مبدأ الستر في الحدود، مبدأ لا جريمة ولا عقوبة إلا بنص في العقوبة الحدية، مبدأ الحدود تدرأ بالشبهات، الشبهات التي تدرأ بها الحدود، وتعد من المخارج الشرعية لإسقاطها، تعريف الشبهات، وأُثرها في الحدود، أقسام الشبهات: أثر الشبهة على العقوبة الحدية، الشبهات المسقطة لحد الزنا، الشبهات المسقطة لحد السرقة، الشبهات المسقطة لحد القذف، الشبهات المسقطة لحد الشرب، الشبهات المسقطة لحد الحرابة، التعزير بوصفه بديلا للعقوبات الحدية حال تعذر إقامتها ، مشروعية التعزير بوصفه بديلا في العقوبة الحدية عند سقوطها و أنواعه، وضوابطه، أنواع العقوبة التعزيرية بوصفها بديلا للعقوبة الحدية عند سقوطها، ضوابط العقوبة التعزيرية بوصفها بديلا للعقوبة الحدية عند سقوطها، التعزير والسياسة الشرعية والعلاقة بينهما ، مفهوم السياسة الشرعية، علاقة التعزير بالسياسة الشرعية، تقنين العقوبة التعزيرية، البدائل للعقوبة التعزيرية في العصر الحديث، الحكم بعقوبة أخرى غير الجلد، الحكم بعقوبة أخرى غير الجلد الحدي، الحكم بعقوبة أخرى غير الجلد التعزيري، الحكم بعقوبة السجن تعزيرًا، الحكم بعقوبة القتل تعزيرًا.   Abstract: This research aims of  the legitimacy of  getting out of cases to dismissing the punishments penalties and the replacement of the punishments of non-regulated punishment   in the Islamic jurisprudence – comparative jurisprudence study the concept of the terminologies of the research: the legitimacy of getting out – dismissing – penalties – punishments – non -regulated punishment  – type of punishments in the Islamic Jurisprudences   and the differences between the penalties punishment and the non-regulated  punishments and the punishments and the general principles of applications and the getting out of dismissing jurisprudences  - type of punishments and its wisdom of their legacy and the agreed punishments  and the punishments differed and the general applications of performing the punishments and the principle of hidden in applying punishments and the principles of crimes  committed the  unavailability of the punishments unless the texts of punishments applied and the principles of punishments of crime committee as the accusation of the  committed punishment as one of the getting out of legitimacy to be dismissed is well known by the defamations of accusations, and their influences in applying punishments and the parts the accusations : the effects of the penalties punishments and accusation of dismissed at the performing the adultery that are dismissed and in case of robbery and the dismissing of defamation of punishments and the drunk dismissed penalties and the bandits dismissed crime and the non – regulated  as an replacement in  the event of being  established and the legitimacy  of non- regulated    as a replacement of penalties punishments when committed and their types and their restrictions and type of non- regulated  by replacements of penalties at the time of dismissing  and the extent of non- regulated  punishments as a replaced by the penalties punishment and the non- regulated  and politics legitimacy  and the relationship among them, and the concept of the policy of legitimacy – the relationship of non- regulated  legitimacy to the rationing of punishment non – regulated  as a replacement for the non- regulated  punishments in the contemporary era and the punishments of punishment by any other types of judgments of instead of flogging and the punishment  judgment instead of the flogging punishment and other judgments  instead of the flogging non-  regulated  and the judgments of imprisoning non -  regulated   and the judgment of killing in non –regulated  sense
