الملخص :
تركز هذه الدراسة علي تتبع فكرة التعددية القانونية في الفكر القانوني والاجتماعي ، والنظم القانونية قديما وحديثا وفي ظل العولمة فقد برزت أهمية دراسة التعددية القانونية في أوائل سبعينيات القرن الماضي نتيجة للبحوث والدراسات التي أجراها علماء الأنثروبولوجيا وعلماء الاجتماع القانوني. وقد أدت التطورات السياسية والاقتصادية إلى تغيير كبير في مفهوم التعددية القانونية نتيجة للترابط العالمي المتزايد. ورغم أن الفقه القانوني نظر إلى هذه الدراسات من موقف معارض، إلا أنه مع تطور المجتمع العالمي، أصبحت التعددية القانونية حقيقة فعلية في مختلف الأنظمة القانونية. وقد كانت التعددية القانونية كواقع اجتماعي موجودة منذ زمن بعيد. فقد سادت التعددية القانونية في أوروبا في العصور الوسطى بمشهدها القانوني المعقد من القانون الإمبراطوري والقانون الكنسي والقانون الإقطاعي والقانون الباروني والقانون العرفي، وكذلك ما هو أبعد من ذلك جغرافيًا وزمانيًا0 من جانب أخر ، فقد عرف القانون المصري منذ القدم التعدد القانوني وحتي العصر الحديث 0
Abstract:
This study focuses on tracing the idea of legal pluralism in legal and social thought, and legal systems in ancient and modern times. In light of globalization, the importance of studying legal pluralism emerged in the early seventies of the last century as a result of research and studies conducted by anthropologists and legal sociologists. Political and economic developments have led to a major change in the concept of legal pluralism as a result of the increasing global interconnectedness. Although legal jurisprudence viewed these studies from an opposing position, with the development of global society, legal pluralism has become an actual reality in various legal systems. Legal pluralism as a social reality has existed for a long time. Legal pluralism prevailed in Europe in the Middle Ages with its complex legal landscape of imperial law, canon law, feudal law, baronial law, and customary law, as well as beyond that geographically and temporally. On the other hand, Egyptian law has known legal pluralism since ancient times until the modern era.
