ملخص البحث
تعتبر الدعوى التجارية من الدعاوى التي أولتها وزارة العدل اهتماماً كبيرا تنظيما وتطويراً، فالقضاء التجاري له مصادره وخصائصه والدعوى التجارية لها شروطها الخاصة التي تنفرد بها والعامة التي تشترك فيها مع غيرها ، ومن هنا تبرز المشكلة التي يعالجها البحث وتثور عدة تساؤلات : ما هي مصادر القضاء التجاري ؟ وما هي خصائصه  ؟ وما هي شروطه؟ فجاء هذا البحث موسوما بعنوان:  ( القضاء التجاري – المصادر – الخصائص – الشروط ) وسوف يكون نطاق البحث في نظام المحكمة التجارية الصادر عام 1350 ونظام المحاكم التجارية الصادر عام 1441هـ، ومن أهم أهداف البحث التي يبرزها الباحث بيان ارتباط المصادر بالشريعة الإسلامية والأنظمة المرعية في المملكة العربية السعودية، وسوف يقوم الباحث باستخدام المنهج الوصفي الاستقرائي للوصول إلى فكرة البحث وأهدافه ، ويعتقد الباحث أن من أهم نتائج البحث : بيان مصادر القضاء التجاري ، بيان خصائص القضاء التجاري ، بيان شروط الدعوى التجارية العامة والخاصة  ومن أهم التوصيات التي يقترحها الباحث : دراسة الدعوى العمالية والجزائية وبيان مصادرها وخصائصها وشروطها ،كما يوصي أيضا بدراسة إجراءات الدعوى العمالية والدعوى الجزائية .
Abstract:
Commercial litigation is one of the litigations that the Ministry of Justice has paid great attention to in terms of organization and development. Commercial litigation has its own sources and characteristics, and commercial litigation has its own conditions that are unique to it and general conditions that it shares with others. Hence, the problem that the research addresses emerges and several questions arise: What are the sources of commercial litigation? What are its characteristics? What are its conditions? This research came under the title: (Commercial litigation - sources - characteristics - conditions) and the scope of the research will be in the Commercial Courts the law issued in 1441 AH. One of the most important objectives of the research that the researcher highlights is to clarify the connection of the sources to Islamic law and the law in force in the Kingdom of Saudi Arabia. The researcher will use the descriptive inductive approach to reach the idea of ​​the research and its objectives. The researcher believes that among the most important results of the research are: clarifying the sources of commercial litigation, clarifying the characteristics of commercial litigation, clarifying the conditions of general and special commercial litigation. Among the most important recommendations proposed by the researcher are: studying labor and criminal litigation and clarifying their sources, characteristics and conditions. He also recommends studying the procedures for labor litigation and criminal litigation.
