ملخص البحث
ينظر بعض الباحثين إلى دليل الاستحسان على أنّه دليلٌ قاصرٌ عن الاستدلال المباشر على الأحكام، وقد توقّف العمل به اجتهاديًّا؛ لضعف أثره، ولاستناده المباشر على النصوص الشرعيّة، وبالتالي لا يعدّ دليلًا مستقلًا بذاته.
إلا أنّ النّاظر في تفاصيل بعض المسائل الاجتهادية المعاصرة، يجد أثرًا واضحًا للاستدلال الاجتهادي بدليل الاستحسان، وإعمالًا جليًّا له، يتمثّل في الدراسة الاجتهادية والتطبيقية لبعض المسائل، وبناء الأحكام فيها، فيما يجوز فيه الاجتهاد، فأحكام الصيام والفِطر مِن أوضح الأمثلة على إعمال الاستحسان وفاعليّته في استنباط الأحكام الشرعيّة المعاصرة، وإصدار الفتاوى الدينية الاجتهاديّة التي ترجع إلى اجتهاد ونظر المفتي.
ويعدّ هذا البحث إشارةً بسيطةً لأثر الاستدلال بالاستحسان في الاستدلال الشرعي، وبناء الأحكام الاستنباطية والفتاوى الاجتهاديّة، ومثالًا تطبيقيًّا؛ للفت أنظار الباحثين الشرعيين إلى هذا الدليل الشرعي العظيم، الذي تتمثّل فيه سماحة الشريعة الإسلاميّة، وقيامها على التيسير والتخفيف على العباد ما استُطيع إلى ذلك سبيلًا.

However, looking at the details of some contemporary jurisprudence issues, finds a clear impact on the ijtihad inference with the evidence of approval, and a clear implementation of it, represented in the jurisprudence and applied study of some issues, and building judgments in it, while it is permissible for ijtihad, so the provisions of fasting and breaking the fast is one of the clearest examples of the implementation of approval and its effectiveness in Developing contemporary legal rulings, and issuing diligent religious fatwas that are due to the diligence and consideration of the Mufti.
This research is a simple indication of the effect of reasoning by approval in legal reasoning, building deductive rulings and diligent fatwas, and an applied example; To draw the attention of the legal researchers to this great legal evidence, in which the tolerance of Islamic law is represented, and its establishment of facilitation and mitigation on the servants, what could be done to this.
