ثمة معاملات في البنوك تأخذ صفة ممنوعة، لكن في ميراثنا الفقهي ما يمكن من خلاله تعديل كثير من المخالفات في البنوك، الأصل في الحيل المشروعة الكتاب والسنة والإجماع، والحيل أنواع: قربة وطاعة، وحيلة محرمة، يجوز التورق المنظم. لأنه بيع لقلة المقرضين ويتخلص من إشكالية التورق الصوري بأن يشتري البنك شراء حقيقياً لسلعة ذات الرقم التسلسلي الدولي، ثم يبيعها، ويمكن أن يوكل العميل البنك في بيعها، واستقرت الفتوى أنه لا حرج في حجز البنوك المال الذي يتم سحبه، مع تأجيل خصمه، فالحجز نوع من القبض الحكمي المعتبر شرعا وعرفا، ومن وأهم المقترحات تعزيز أعمال البنوك وفق الصور الصحيحة مع التنبه أن الأصل في البنوك المشاركة في مجالات التنمية.
