ملخص البحث الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه أجمعين، أما بعد: فهذا بحث عن النكول وأثره على دعوى القصاص المجردة عن البينة واللوث، جعلته في تمهيد وثلاثة مباحث، والتمهيد يتضمن مطلبين، الأول في حقيقة النكول في اللغة والاصطلاح، والثاني في صفة النكول، والمبحث الأول في الحكم بالنكول، والمبحث الثاني في سماع دعوى القصاص المجردة عن البينة واللوث، وفيه مطلبان، الأول في حكم سماع الدعوى ابتداءً، والثاني في عدد الأيمان الواجبة عند من يقول بسماعها، ثم المبحث الثالث في النكول وأثره على دعوى القصاص المجردة عن البينة واللوث، وجعلته في مطلبين، الأول في النكول وأثره على دعوى القصاص المجردة عن البينة واللوث، والثاني في سبب الخلاف في المسألة، ثم الخاتمة، وفيها خلاصة البحث، وأهم نتائجه، ثم توصيات البحث، ثم ختمت هذا البحث بفهرس أهم المصادر والمراجع، وكان من أهم النتائج : ^  أن حقيقة النكول الاصطلاحية هي: امتناع من وجبت عليه أو له يمين منها. ^  أن النكول إما أن يكون: حقيقيًا أو حكميًا. ^  اختلاف الفقهاء في الحكم بالنكول على أقوال متعددة، والأدلة فيها متعارضة، والقول الذي ظهر للباحث هو الجمع بينها كما تقدم في البحث. وكان من أهم التوصيات: ^  العناية بدقيق مسائل القضاء وتحرير الكلام فيها؛ لعلاقتها بالحكم في أموال الناس وأنفسهم وأعراضهم . ^  الكتابة في موضوع النكول وأثره على دعوى القصاص فيما دون النفس. ^  الكتابة في موضوع النكول وأثره على الحدود التي تدخلها الأيمان واللعان. وأسأل الله أن يجعله لكاتبه نافعاً، ولقارئه مفيداً ومثرياً . وصلى الله وسلم على نبينا محمد .
