ملخص البحث  تناول البحث دراسة القواعد الفقهية المتعلقة بالعقود المؤثرة في أحكام وسائل التواصل الاجتماعي، فقد تناولت فيه أهم القواعد الفقهية المتعلقة بالعقود، وهي ثلاث قواعد من عدة جوانب: (معنى القاعدة، ودليلها، والقواعد المتفقة مع أصل القاعدة إن وجدت، وشروط إعمال القاعدة إن وجدت)، وتظهر القيمة العلمية للبحث من خلال تطبيق القواعد الفقهية المتعلقة بالعقود التي تمت دراستها نظرياً على بعض الفروع المعاصرة، وذلك من خلال الجمع بين منهجي الاستقراء والتطبيق، وقد انتظم البحث بمقدمة، وستة مباحث، وما لزم لكل مبحث من أفرع، ثم خاتمة اشتملت على أهم النتائج والتوصيات ، ومن أبرز النتائج والتوصيات التي توصل إليها البحث : - للعقود ثلاثة أركان يتوقف وجود العقد عليها؛ (الصيغة، والعاقدان، ومحل العقد). - للشروط في العقود تقسيمات باعتبارات متعددة؛ (باعتبار شروط الانعقاد، وباعتبار شروط الصحة، وباعتبار شروط النفاذ، وباعتبار شروط اللزوم). - أثر قاعدة "الأصل في العقود والشروط ‌الجواز ‌والصحة" على بعض الفروع الفقهية المعاصرة المتعلقة بالعقود، كأثرها على صحة إنشاء وتوثيق عقود الموظفين إلكترونياً. وتوصي الباحثة بإعداد بحوث مماثلة في القواعد التي يجمعها موضوع واحد، لتطبيق ما يمكن تطبيقه من الفروع الفقهية المعاصرة عليها : القواعد الفقهية المؤثرة في الأحكام الطبية الفقهية المعاصرة ، والقواعد الفقهية المؤثرة في أحكام السفر. Abstract  This research explores the Fiqh rules related to contracts that influence the judgments on social media platforms. It focuses on the most significant rules concerning contracts, covering three rules from several aspects: the meaning of the rule, its evidence, any related rules consistent with the basic principle (if any), and the conditions for applying the rule (if any). The scientific value of the research is demonstrated through the theoretical examination of these Fiqh rules on contracts and their practical application on contemporary branches. This is achieved by combining inductive and applied methodologies. The research is organized into an introduction, six main discussions, and the necessary subdivisions for each discussion, culminating in a conclusion that includes the most important findings and recommen dations.The most prominent results and recommendations reached by the research are: - Contracts have three pillars on which the existence of the contract depends; (the formula, the contracting parties, and the subject of the contract.( - Conditions in contracts are divided according to multiple considerations; (considering the conditions of the conclusion, considering the conditions of validity, considering the conditions of enforcement, and considering the conditions of necessity.( - The impact of the rule "The origin of contracts and conditions is permissibility and validity" on some contemporary branches of jurisprudence related to contracts, such as its impact on the validity of creating and documenting employee contracts electronically. The researcher recommends preparing similar research on the rules that are united by one topic, to apply what can be applied from contemporary branches of jurisprudence to them: the jurisprudential rules affecting contemporary jurisprudential medical rulings, and the jurisprudential rules affecting travel rulings.
