ملخص البحث
يتناول بحث "أحكام الغائب والمفقود في الفقه الإسلامي والنظام السعودي والقانون المصري: دراسة فقهية مقارنة" دراسة أحكام الغائب في الفقه الإسلامي والنظام السعودي والمصري من حيث التعريف والأقسام والأحكام في المبحث الأول. وأما المبحث الثاني فيتناول أحكام المفقود في الفقه الإسلامي والنظام السعودي والقانون المصري من حيث التعريف والأقسام والأحكام، واختتم هذا المبحث بالتفريق بين الغائب والمفقود في الفقه الإسلامي والنظام السعودي والقانون المصري.
وتوصلت من هذه الدراسة لعدد من النتائج منها : جاءت أحكام الغائب والمفقود في نظام الأحوال الشخصية السعودي في الفصل الخامس، بداية من المادة الحادية والستين بعد المائة إلى المادة الثامنة والستين بعد المائة. يعد الفقه الإسلامي المصدر الرئيس لكل من النظام السعودي والقانون المصري في الأحوال الشخصية. اختصر النظام السعودي بعض الأحكام التي استطرد فيها القانون المصري بداية، ثم عُدلت بعد ذلك، في إشارة إلى أن النظام السعودي استفاد من التجارب القانونية السابقة.
ومن أهم التوصيات: إجراء المزيد من الدراسات حول نظام الأحوال الشخصية؛ نظرًا لحداثته. ضرورة وقوف الباحثين على الموضوعات المستجدة في نظام الأحوال الشخصية، وذلك لمعرفة نعمة الله على هذه الدولة بالتمسك بالكتاب والسنة وما كان عليه سلف هذه الأمة. أهمية ربط الدراسات الشرعية بالدراسات القانونية، وضرورة الإفادة منهما بالمقارنات التشريعية، لمعرفة مزايا النظام الإسلامي وتفوقه.

Abstract:
This study named as: “The Rulings of the absent and lost in both of Islamic Jurisprudence and Saudi Arabia's Personal Status Law and Egypt's Personal Status Law: Comparative Fiqh Study", includes in the first chapter the definition, types and rulings of the absent in Islamic Law and Saudi Arabia's Personal Status Law and Egypt's Personal Status Law.
While the second chapter consists of the definition, types and rulings of the lost in Islamic Law and Saudi Arabia's Personal Status Law and Egypt's Personal Status Law. As well as, this chapter finalizes with the distinction between the absent and lost in Islamic Law and Saudi Arabia's Personal Status Law and Egypt's Personal Status Law.
From this study, I reached a number of results, including: The provisions for the absent and missing person in the Saudi Personal Status Law came in Chapter Five, starting from Article 161 to Article 168. Islamic jurisprudence is the main source for both the Saudi system and Egyptian law in personal status. The Saudi regime initially shortened some provisions that Egyptian law included, and then they were amended, indicating that the Saudi regime benefited from previous legal experiences.
Among the most important recommendations are: conducting more studies on the personal status system; Due to its modernity. It is necessary for researchers to study the emerging issues in the personal status system, in order to know the blessing of God upon this country by adhering to the Qur'an and the Sunnah and what the predecessors of this nation were upon. The importance of linking Sharia studies with legal studies, and the necessity of benefiting from them through legislative comparisons, to know the advantages and superiority of the Islamic system.
