يستهدف البحث معالجة أهم المسائل المالية والاقتصادية لإحدى الفئات من ذوي الاحتياجات الخاصة وهم التوائم المتلاصقة، التي تعد من آيات قدرة الله تعالى في الخلق، وعلى ندرتها كثُرت إشكالياتها، فَفي تحديد كُنهها وماهية خِلقتها تعددت الإشكاليات: فهل هي ذكر أم أنثى؟ وهل شخص أم اثنين؟ وهل يجوز فصلهما حالة كونهما اثنين أم لا؟ وهل يعامل ذلك الجسد الذي يحمل بداخله روحين وشخصيتين مختلفتين على أنه شخص واحد أم اثنين؟ وهل من حق ذلك التوأم المتحد الجسد في معظم اعضاءه أن يمارس الحياة كإنسان له من الحقوق وعليه من الواجبات ما لأى مكلف عادى؟ وفي جانب التكاليف وُجدت الكثير من الإشكاليات الشرعية، فمثلاً: كيف يصلى ويصوم ويحج؟ وكيف يتزوج ؟ كذلك في جانب الحقوق والواجبات المالية والاقتصادية، هل له نفس الحقوق التي يتمتع بها الإنسان الطبيعى؟ وهل يتحمل من الواجبات مثل ذلك؟ ولما كان المقام لا يتسع لدراسة كافة أحكام جوانب حياة هذا المخلوق البشري، في بحث مثل هذا له محدوديته؛ رأيت أن أتناول جانباً من الجوانب، وهو: الحقوق والواجبات المالية والاقتصادية وأهم إشكالياتها وكيف عالجتها الشريعة الإسلامية؛ وقد قسمت البحث إلى مبحثين في كل منها عدة مطالب: المبحث الأول: يتناول: تعريف التوأم المتلاصق وبيان ماهيته ونسبته لذوي الاحتياجات الخاصة، وتحديد كونه شخص أم إثنين، وإشكاليات حقوقه وواجباته المالية والاقتصادية، كالشخصية القانونية والأهلية الشرعية، والحماية اللازمة لها، ويتناول المبحث الثانى: بيان أحكام أهم الحقوق والواجبات المالية والاقتصادية: كالميراث، والوصية، والنفقة، والدية، والزكاة عن المال والبدن، والحق في التملك، والتصرف، والعمل، ثم ختمت البحث بأهم نتائجه، وتوصياته، وبيان مصادره، سائلا الله التوفيق والسداد. The research aims to address the most important financial and economic issues for one of the groups of people with special needs, namely contiguous twins, which are one of the signs of the power of God Almighty in creation, and on their rarity, their problems abounded, in determining what they were and what they created, there were many problems: is it male or female? Is it one or two? Is it permissible to separate them if they are two or not? Is that body that carries within it two different souls and personalities treated as one person or two? Is it the right of that twin, united in most of its members, to exercise life as a human being with the rights and duties of any ordinary taxpayer? On the cost side, there are many legal problems, for example: How to pray, fast and make Hajj? How can he get married? Also, in terms of financial and economic rights and duties, does he have the same rights as natural humans? Does he have such duties? And since the denominator does not have enough space to study all The provisions of aspects of the life of this human creature, in a research like this has its limitations; I saw that I should address one of the aspects, namely: financial and economic rights and duties and the most important problems and how the Islamic Sharia dealt with them; and I divided the research into two papers in each of which there are several demands: the first: statement of the provisions of the most important financial and economic rights and duties: Such as inheritance, will, alimony, Parenthood, zakat for money and body, the right to own property, disposal, and work, and then concluded the research with its most important results, recommendations, and the statement of its sources, asking Allah to reconcile and repay.
