يلقي هذا البحث الضوء على تعريف معنى الحقوق وأنواعها بصفة عامة في الشريعة الإسلامية والقانون ثم بيان المقصود من الحقوق الاجتماعية لذوى الاعاقة في نطاق الشريعة والقانون ، وتجدر الإشارة  أن مفاد ما ورد  في المدونات القانونية هو رعاية الحقوق الاجتماعية وغيرها من الحقوق سواء الحقوق السياسة أو الاقتصادية والتعليمة والطبية ومن قبيل الحقوق الاجتماعية ضمان حد لائق من المعيشة لذوى الإعاقة كاف لتأمين صحتهم وكرامة وجودهم في الغذاء والكساء والملبس والعناية العلمية والخدمات الاجتماعية الضرورية  وصرف مبالغ نقدية شهرية وصرف معاشات لهم وللأرامل والمطلقات ولكل عاجز عن الكسب. وقد أقرت الشريعة الإسلامية حقوقا اجتماعية لذوي الههم منها ضمان حد الكفاية يشمل نفقات مسكن لائق ونفقات التعليم والعلاج وسائر النفقات الطبية لذوى الهمم ومنها أيضا الضمان الاجتماعي الذي يشمل النفقات على الفقراء والمساكين من ذوى الإعاقة والحاجة من حصيلة الزكاة وكذا من النفقة الواجبة على الأقارب على أقاربهم المحتاجين ولاسيما ذوى الإعاقة ولقد توسع المذهب الحنبلي في النفقة عليهم حتي شمل إعطاء النفقة  لكل وارث صاحب فرض أو تعصيب وحتى ذوى الأرحام من عمودي النسب وأيضا يمول الضمان الاجتماعي لذوى الإعاقة من الوقف والعطاء حتي نادي الفقهاء بالوقف والعطية لكل رجل أو امرأة به عاهة أو إعاقة تمنعه عن الكسب والعمل وكذا صرف معاشات لهم ولذريتهم ولنسائهم بعد وفاتهم ومن هذا يتبين أن تمويل الضمان الاجتماعي يكون من المالية العامة للدولة والمالية الخاصة للأفراد على خلاف التمويل في القانون يكون من المالية العامة للدولة فقط كما أقرت الشريعة أيضا حق الرعاية الطبية لذوي الإعاقة ولغيرهم.
