أن أفعال المكلفين إذا كانت بقصد التعنت وإدخال المشقة على الغير، فإن الشرع يعامل فاعلها بنقيض قصده، فيرد عليه فعله، فلا يترتب عليه أثره ولا تنتُج عنه نتائجه؛ عقوبة من الشرع له بسبب سوء قصده.
وقد تناول البحث دراسة التعنت والفرق بينه وبين التعسف، وأمارات التعنت وأقسامه، ثم تطرق لدراسة الفروع الفقهية المتعلقة بالتعنت، وكيف تم رد التعنت فيها، وربط هذه الفروع بالقواعد والضوابط الفقهية.
وقد قمت باستقراء كتب الفقه وأصوله -استقراء ناقصاً- لاستخراج الفروع الفقهية لموضوع البحث من مصادرها المعتمدة، ثم المنهج التحليلي الذي يقوم على تحليل ما ورد عن أئمة المذاهب من ردٍ للتعنت فيما يخص موضوع البحث، ثم المنهج الاستنباطي الذي يساعد في الوصول إلى استنباط القواعد والضوابط المناسبة لكل مسألة وربط الفروع بقواعدها وضوابطها الفقهية.
وكان من أهم النتائج التي توصلت إليها من خلال هذا البحث: أن المتعنت: هو المشدِّد الَّذِي يُكَلف غَيره مَا يصعب عَلَيْهِ، وأن مجال التعسف أضيق من التعنت؛ لاقتصاره على استعمال الحقوق المشروعة في إدخال الضرر على غيره، بخلاف التعنت، وأن التعنت مردود في شريعة الإسلام، وقد نحا هذا النحو فقهاؤنا الأجلاء فردوا تعنت المتعنتين في كثير من الفروع الفقهية، ذكرتُها مقترنة بقواعدها الفقهية.
If the actions of those charged with the duty are intended to be obstinate and cause hardship to others, then the Sharia treats the doer with the opposite of his intention, so his action is rejected, and its effect does not result, nor does it produce its results; a punishment from the Sharia for him because of his bad intention.
The research dealt with the study of obstinacy and the difference between it and arbitrariness, and the signs of obstinacy and its types, then it addressed the study of the jurisprudential branches related to obstinacy, and how obstinacy was rejected in it, and linked these branches to the jurisprudential rules and controls.
I conducted an incomplete induction of the books of jurisprudence and its principles to extract the jurisprudential branches of the research topic from their approved sources, then the analytical method that is based on analyzing what was reported by the imams of the schools of thought in rejecting obstinacy regarding the research topic, then the deductive method that helps in arriving at the deduction of the appropriate rules and controls for each issue and linking the branches to their jurisprudential rules and controls.
One of the most important results I reached through this research is that the obstinate person is the one who imposes on others what is difficult for them, and that the scope of arbitrariness is narrower than obstinacy, as it is limited to using legitimate rights to cause harm to others, unlike obstinacy, and that obstinacy is rejected in Islamic law. Our venerable jurists have taken this approach and rejected the obstinacy of the obstinate in many branches of jurisprudence, which I have mentioned in conjunction with their jurisprudential rules.
