يعد الحبس الاحتياطي إجراءً وقائياً يقرر لمصلحة التحقيق، وهذا الإجراء بطبيعته ماس للحرية الفردية للمتهم، غير أنه وبعد التحقيق والمحاكمة قد تقرر المحكمة المختصة براءة المتهم، أو أن تقرر سلطة التحقيق قراراً بحفظ التحقيق. مما قد تتعارض المصلحة العامة ومصلحة الحرية الفردية.      وبناءً على ذلك سعى الكثير من الفقهاء إلى التوفيق بين هاتين المصلحتين، ووضع إجراء آخر يوافق بين هاتين المصلحتين وهو إجراء المراقبة الإلكترونية بديلا عن الحبس الاحتياطي.   وفي هذا البحث تطرقنا لمفهوم المراقبة الإلكترونية وطبيعتها القانونية وتقييمها، كما تطرقنا لشروط المراقبة الإلكترونية وإشكالياتها وصولاً إلى النتائج والتوصيات التي نرى من جانبنا أنها صالحة بديلا للحبس الاحتياطي وتطبيقها في القانون الكويتي.    Abstract: Pretril detention is considered a preventive measure decided for the benefit of the investigatiom,and this measure, by its nature, violates the individual freedom of the accused.After investigation and trial,the competent court may decide to acquit the accused,or the investigation authority may decide to dismiss the   investigation,which conflict with the public interest and the interest of individual freedom. In the research, we discussed the concept of home detention , its legal nature, and its evaluation. We also touched on the condition of  home detention,and its problems, arriving at useful results and recommendation for kuwati law.
