شهدت الآونة الأخيرة تطورًا هائلًا في تخصص الذكاء الاصطناعي (AI) نتيجة التقدم الهائل في مجال التقنيات التكنولوجية، ‏ الأمر الذي جعل منه إحدى المستجدات على الساحة القانونية والتي أثارت العديد من المشكلات القانونية والتطبيقية؛ وذلك بسبب عدم كفاية القوانين والتشريعات القائمة لمجابهة هذه التطورات، وعجز هذه القوانين في الكثير من الأحيان عن إيجاد الحلول العملية لتلك المشكلات القانونية. أما عن أهم المشكلات التي أثيرت بسبب الاعتماد على تقنية الذكاء الاصطناعي فهي مسائل حقوق الملكية الفكرية، وبالأخص الملكية الصناعية. ولما كان أهم صور حقوق الملكية الصناعية هي حق براءة الاختراع والتي تعد مجالًا خصبًا لتطبيقات تقنية‏ الذكاء الاصطناعي، وجب بيان الحكم الشرعي في الفقه الإسلامي عن تلك الأعمال التي تكون وليدة لتقنية الذكاء الاصطناعي التكنولوجية، و قد تناول هذا البحث المعالجة القانونية الممنوحة للأعمال الذهنية، ومنها كيفية التعامل مع مستجدات تقنيات الذكاء الاصطناعي في مجال براءة الاختراع في ظل قوانين الملكية الفكرية القائمة، وكيفية حماية براءة الاختراع المستنبطة بالذكاء الاصطناعي؛ وذلك باتخاذ الإجراءات الوقائية والعلاجية لحماية هذه البراءة.    Abstract: Recent developments in the specialization of artificial intelligence (AI) have been the result of tremendous advances in the field of technology, making it an innovation in the legal arena that has raised many legal and applied problems. because existing laws and legislation are insufficient to cope with these developments and these laws often fail to find practical solutions to these legal problems The most important problems raised by the reliance on artificial intelligence technology are intellectual property rights issues, Especially industrial property, since the most important images of industrial property rights are patent rights, which are a fertile area for AI technology applications, The legitimate judgment in Islamic jurisprudence must be stated on those works that are born of technological artificial intelligence technology And the researcher in this research had to deal with the legal treatment given to mental work, These include how to deal with developments in AI technologies in the patent field under existing intellectual property laws and how to protect an AI-generated patent by taking preventive and remedial action to protect these plantations
