يرصد هذا البحث تداخل المنطق الأرسطي مع منطق الفقهاء المسلمين (علم أصول الفقه)، وأوضح البحث أنه رغم النشأة الأصيلة لعلم أصول الفقه على يد العلماء المسلمين؛ فإنه كان كغيره من العلوم المنفتحة على ثقافات الحضارات الأخرى، وخاصة المنطق الأرسطي الذي يُعدُّ وافدًا مؤثرًا ومتجسدًا في بعض مبادئه؛ كآلية الحدّ، وآليات الاستدلال، ودلالة الألفاظ على المعاني؛ ومن ثم يهدف البحث إلى كشف تلك الآليات من خلال التصورات والتصديقات في موطأ الإمام مالك (رضي الله عنه)، للوصول إلى بيان حقيقة تأثره بالمنطق الأرسطي سواء كان ذلك بطريقة مباشرة أم غير مباشرة.

Abstract:

This research discusses the overlap of the Aristotelian logic with the logic of Muslim jurists (Islamic jurisprudence, Ilm Usul al-Fiqh). The re-search explains that despite the authentic emergence of the principles of ju-risprudence by Muslim scholars; it was like other sciences that are open to the cultures of other civilizations, especially the Aristotelian logic, which is an influential and expressive factor in some of its principles, such as the ba-sics of the logical terms, the basics of inference, and the significance of words on meanings. The research aims to reveal those terms through percep-tions and ratifications in the “Muwatta of Imam Malik", to reach a statement of the fact that it was influenced by Aristotelian logic, whether it was directly or indirectly.
