أدى استخدام الإنترنت إلى حدوث مشاكل قانونية متعددة منها ما يتعلق بكيفية حماية المصنفات الأدبية والفنية المتاحة في البيئة الرقمية، وإزاء هذا المشاكل وعجز القوانين والاتفاقيات عن حل الكثير منها فكان لا بد من البحث عن حلول لمواجهتها ، وذلك لأن  أصحاب حق المؤلف يواجهون في البيئة الرقمية المتشابكة عددا ً كبيرا ً من الصعوبات والقضايا والمشكلات بسبب النشر في هذه البيئة الرقمية أو إتاحة مصنفاتهم عليها، والتي يرجع السبب في وجود غالبيتها إلى السهولة التي يمكن من خلالها استنساخ المواد المنشورة الكترونياً على الانترنت وقلة التكاليف المالية التي تستلزم ذلك . وبالتالي فإن المشاكل التي ظهرت في البيئة الرقمية بالنسبة لحقوق المؤلفين أصبحت تقلق العالم ممــــــــــــــــا أدى إلى اتجاه  العديد من الدول ومنها في دولنا العربية إلى تشريع القوانين التي تحمي هذه الحقوق ذات الطبيعة الخاصة ومنها مصر من خلال قانون حماية الملكية الفكرية رقم82 لسنة 2002 ، و المملكة العربية السعودية من خلال نظام حماية حقوق المؤلف  1424 . ولاهمية هذا الموضوع سيتم تناوله بالاعتماد على مناهج بحثية متعددة منها المنهج التأصيلي لتأصيل  حقوق المؤلف والحقوق المجاورة لها بأنواعها، والمنهج المقارن للمقارنة بين القدرة الحمائية لأحكام قانون حماية حقوق الملكية الفكرية المصري رقم 82 لسنة 2002م ، ونظام حماية حقوق المؤلف السعودي 1424. في ترسيخ حماية حقوق المؤلف لأعماله عبر الانترنت،المنهج التحليلي لدراسة ووصف تلك الحقوق. وسيتم تناول ذلك من خلال مقدمة وثلاثة مباحث مبحث تمهيدي بعنوان ماهية حق المؤلف وما يرتبط بها  ، ثم مبحث أول  بعنوان حقوق المؤلف في ظل النشر الإلكتروني يليه المبحث ثان بعنوان أوجه الحماية القانونية لحق المؤلف، خاتمة، نتائج وتوصيات، المراجع The use of the Internet has led to the occurrence of multiple legal problems, including those related to how to protect literary and artistic works available in the digital environment.
