الملخـــص:
لقد تحدثت هذه الدراسة عن مسألة قانونية من مسائل القضاء الشرعي على وجه الخصوص، وهي مسألة: طرق الطعن في الأحكام القضائية كما تجريها المحاكم الشرعية الأردنية بحسب قانون أصول المحاكمات الشرعي الأردني رقم 31 وتعديلاته حتى عام 2016م، وذلك بإتباع المنهجين الاستقرائي، والتحليلي التطبيقي. اشتملت الدراسة على مطلبين ومجموعة من الفروع، حيث عرفت الأحكام والقرارات في ضوء قانون أصول المحاكمات الشرعية الأردني المعدل لعام 2016
وأنواع الأحكام والقرارات القضائية، وطرق الطعن العادية في القضاء الشرعي الأردني كما تجريها المحاكم الشرعية الأردنية، فاشتملت الدراسة على التعريف بالأحكام والقرارات في ضوء قانون أصول المحاكمات الشرعية الأردني رقم 31 وتعديلاته حتى عام 2016م، والمواد القانونية المنظمة للأحكام والقرارات في القضاء الشرعي الأردني، وأنواع الأحكام القضائية، وأنواع القرارات القضائية، والفرق بين الحكم القضائي والقرار القضائي، وتعريف الطعن بالأحكام، ومشروعيته،
وبيان أهمية فقه القضاء، ومدى إلزاميته للخصوم، والتعريف بحقيقة وماهية الطعن بالأحكام القضائية، ومشروعية الطعون بالأحكام القضائية، والتأصيل الفقهي للطعون بالحكم القضائي، وطرق الطعن الاعتيادية في الأحكام القضائية: الاعتراض على الحكم الغيابي، والاستئناف.
Abstract
This research demonstrates a legal issue belonging to the field of Islamic judiciary. This issue is concerned with the ordinary ways of appeal against judicial rulings as applied by the Jordanian Islamic courts in accordance with the Jordanian law of Islamic procedures No. 31and its amendments till 2016 A.D. The research applies the inductive, analytical, and applied approaches. The research includes two requirements and a group of sub- issues where rulings and decisions were identified in the light of Jordanian law of Islamic procedures amended in 2016, kinds of rulings, judicial decisions, and the ordinary ways of appeal against them in the Jordanian Islamic judiciary as applied by the Jordanian Islamic courts. The research also includes definitions of rulings and decisions in the light of the Jordanian law of Islamic procedures No. 31, its amendments till 2016, the legal articles organizing rulings and decisions of Jordanian Islamic judiciary, kinds of judicial rulings, types of judicial decisions, the difference between judicial rulings and decisions, definitions of judicial appeals and their legitimacy. The research is also keen on displaying the importance of judiciary, the extent of its power over opponents to be remain obliged, defining the origins of appeal against the judicial rulings- their legitimacy, jurisprudential rooting of appeals against judicial rulings and the ordinary ways of appeal against rulings; objection to absentee judgment and appellation.
