لقد اهتمت الشريعة الإسلامية بالنظام القضائي، ووضعت له الأسس والقواعد التي تتفق مع عدالتها ومرونتها وصلاحيتها لكل زمان ومكان، وكان من أهم تلك الأسس ما يتعلق بنظام الإثبات، لكونه الأداة التي يعول عليها القاضي في إثبات الحقيقة ،والوسيلة التي يعتمد عليها الأفراد في صيانة حقوقهم ،ويمثل الإثبات الجنائي بالوسائل العلمية الحديثة الجانب التطبيقي لنظام يتلائم مع الواقع الحالي، وما يشهده من تطور تكنولوجى متسارع، والهدف من  هذه الدراسة هو توضيح ماهية الوسائل العلمية الحديثة ،ومدى حجيتها في الإثبات الجنائي، ودور القواعد الفقهية  في ترشيد الاجتهاد في نوازل الإثبات الجنائي المعاصرة ،وتبرز أهمية الدراسة في كونها تناولت بالشرح والتفصيل أحدث الوسائل العلمية وأكثرها تطورا واستخداما في قضايا الإثبات الجنائي، وذلك من خلال بيان  طبيعة هذه الوسائل، وعرضها على الشريعة ،وبيان ما يتوافق منها مع قواعدها، ويحقق مقاصدها، بغية الاعتماد عليها كدليل من أدلة الإثبات ،ثم خلصت في النهاية إلى ذكر النتائج المترتبة على ذلك كله ، وكيف أن الوسائل العلمية الحديثة قد أصبح لها من القوة الدلالية والإثباتية أمام الجهات القضائية ما يجعلها من القرائن القوية المعتبرة شرعا، بل ما قد يؤهلها لتكون دليلا مستقلا بذاته. Islamic Sharia has taken an interest in the judicial system, laying down principles and rules that align with its justice, flexibility, and suitability for all times and places. Among the most important of these principles is that related to the system of evidence. Its importance lies in being the tool relied upon by judges to prove the truth and the means relied upon by individuals to safeguard their rights. Modern scientific methods in criminal evidence represent the practical aspect of a system that aligns with the current reality and the rapid technological advancements witnessed. The objective of this study is to clarify the nature of modern scientific methods and their validity in criminal evidence, as well as the role of jurisprudential principles in guiding the reasoning in contemporary issues of criminal evidence. The significance of the study lies in its detailed examination of the latest and most advanced scientific methods used in criminal evidence, by explaining their nature, presenting them in light of Sharia, and highlighting their compatibility with its principles and objectives, aiming to rely on them as evidence. Finally, the study concludes by mentioning the resulting implications, illustrating how modern scientific methods have gained evidential strength before judicial authorities, making them strong and credible indicators from a Sharia perspective, and possibly qualifying them to be independent evidence.
