تهدف الدراسة إلى بيان حكم التداوي بتقنية النانو، وهي تقنية جديدة ومعاصرة، ولها تطبيقات متعددة في مجالات الحياة المختلفة كالطب والهندسة والطاقة وغيرها، وتعتبر المسائل المتعلقة بها من النوازل الفقهية التي تحتاج إلى بحث أحكامها، وتتضمن هذه الدراسة بيان مفهوم تقنية النانو, ومدى مشروعيته في التداوي ونشأته، وحكم استخدامه في العقاقير والأدوية الطبية، وفي علاج الخلايا السرطانية، وعلاج مرض السكري وغيرها، من خلال العلاج بجسيمات الذهب أو الفضة النانوية، وبيان التكييف الفقهي لاستخدامهما في التداوي، موضحة في نهاية الدراسة تأثير تقنية النانو من حيث الايجابيات والسلبيات، وقد سلكت في هذه الدراسة المنهج الوصفي في تعريف تقنية النانو ونشأته وكيفية استخدامه لعلاج الخلايا السرطانية، ومرض السكري وغيرها، ثم اتبعت المنهج الاستقرائي في تتبع المسائل المذكورة في كتب الفقهاء، التي لها صلة بهذه التطبيقات النانوية الطبية، ثم المنهج الاستنباطي في استخراج الأحكام لهذه التطبيقات من النصوص والقواعد التي يمكن تخريجها عليها، وتوصلت في النهاية إلى: أن هناك نصوصاً وقواعد فقهية تحكم مشروعية التداوي بشكل عام تفيد جواز استخدام تقنية النانو كوسيلة طبية معاصرة ما لم يترتب على استخدامها ضرر بصحة الإنسان، وجواز استخدام جسيمات الذهب والفضة للتداوي في حدود الضرورة، وأن تقنية النانو شأنها شأن كل التقنيات المعاصرة لها جوانب ايجابية وأخرى سلبية. The study aims to show the rule of medication through nanotechnology, which is a new and contemporary technology with multiple applications in various fields of life, such as medicine, engineering, energy and others. The issues related to it are among the jurisprudential barriers that need to be examined in its provisions. This study includes clarifying the concept of nanotechnology, the extent of its legitimacy in medication and its origins, the use of it in drugs and medical drugs, in the treatment of cancer cells, in the treatment of diabetes and others, through treatment with gold particles or nanosilver particles, the statement of jurisprudential conditioning for use in medication. At the end of the study, it explained the effect of nanotechnology in terms of pros and cons. It was followed in this approach to the study, the definition of the technique method and treatment of cancer, and its treatment, and how it followed My opinion is to track the issues mentioned in the Legal Scholars' Books, which are related to these medical nanomedical applications, and then the deductive approach in extracting provisions for these applications from the texts and rules that can be extracted from them, which led to the conclusion in the end that there are jurisprudential texts and rules governing the legitimacy of medication in general, that nanotechnology may be used as a contemporary medical method unless its use results in harm to human health, and that gold and silver particles may be used for medication as long as necessary, and that nanotechnology, like all contemporary techniques, has both positive and negative aspects.
