وضحنًا إِشْكَالِيَّةَ تَحْضِيرِ الدَّعْوَى الْإِدَارِيَّةِ فِي الْقَانُونِ الْأُرْدُنِيِّ مَعَ الْإشَارَةِ إِلَى الْقَانُونِ الْفَرَنْسِيِّ وَالْمِصْرِيِّ مِنْ خِلَالَ أَنَّ تَحْضِيرَ الدَّعْوَى الْإِدَارِيَّةِ هِي عِبَارَةٌ عَنْ مَجْمُوعَةٍ مِنَ الْإِجْرَاءَاتِ الَّتِي تَتَّخِذُ مِنْ لَحْظَةِ إِيدَاعِ الدَّعْوَى قَلَمَ كِتَابِ الْمَحْكَمَةِ الْمُخْتَصَّةِ، وَحُتِّي صُدُورَ الْحُكْمِ فِي الدَّعْوَى الْإِدَارِيَّةِ، أَوْ تهِيِئِتهَا مِنْ قَبْلَ الْجِهَةِ الْمُخْتَصَّةِ بَعْدَ إِيدَاعِهَا قَلَمَ كِتَابِ الْمَحْكَمَةِ بإتخاذ كَافَّةَ الْإِجْرَاءَاتِ الَّتِي مَنْحِهَا لَهَا الْقَانُونُ لِجَعَلَ الدَّعْوَى الْإِدَارِيَّةُ صَالِحَةٌ لِلْحُكْمِ.
إِذَا تَبَيُّنٍ لَنَا عَدَمُ وُجُودِ مُفَوَّضِ الدَّوْلَةِ أَوْ هَيْئَةُ مُفَوَّضِيُّ الدَّوْلَةِ فِي قَانُونِ الْقَضَاءِ الْإِدَارِيِّ الْأُرْدُنِيِّ رَقْمَ (27) لِسَنَةِ 2014، مَعَ الْعِلْمِ أَنَّهُ حَديثُ النَّشْأَةِ وَلَمْ يَأْخُذْ بِفِكْرَةِ تَحْضِيرِ الدَّعْوَى الْإِدَارِيَّةِ الَّتِي مُطَبَّقَةُ فِي فَرَنْسَا وَمِصْرٍ، وَالَّتِي يَكْوُنَّ لَهَا دَوْرُ كَبِيرُ وَفَعَّالٌ فِي تهِيِئَة الدَّعْوَى لِلْمُرَافَعَةِ وُصُولًا لِلْحُكْمِ الْمَنْهِيِّ فِيهَا.
كَذَلِكَ يَتَأَثَّرُ الْحُكْمُ الْقَضَائِيُّ الْإِدَارِيُّ الصَّادِرُ فِي الدَّعْوَى الْإِدَارِيَّةِ بِتَحْضِيرِ الدَّعْوَى وتهيئتها مِنْ خِلَالَ مُفَوَّضُ الدَّوْلَةِ، حَيْثُ يَتَمَتَّعُ الْحُكْمُ الْقَضَائِيُّ الصَّادِرُ بِإلْغَاءِ الْقَرَارِ الْإِدَارِيِّ، بِحَجِّيَّةِ الْأَمْرِ الْمَقْضِيِّ بِهِ، مِثْلُ سَائِرُ الْأَحْكَامِ الْقَضَائِيَّةِ الْقَطْعِيَّةِ، وَهَذِهِ الْحُجِّيَّةِ لَا تَقْتَصِرْ عَلَى حُكْمِ الْإلْغَاءِ، وَإِنَّمَا تَشْمَلُ الْأَحْكَامُ الْقَضَائِيَّةُ الصَّادِرَةُ بِرَفْضِ الدَّعْوِيِّ، وَاُلْحُكُمْ بِالْاِخْتِصَاصِ، وَاُلْحُكُمْ بِالْقَبُولِ، وَالْحُكْمَ الْقَضَائِيَّ الصَّادِرَ بِوَقْفِ تَنْفِيذِ الْقَرَارِ الْإِدَارِيِّ.
We explained the problem of preparing an administrative case in Jordanian law, with reference to French and Egyptian law, by stating that the preparation of an administrative case is a set of procedures that are taken from the moment the case is filed with the clerk of the competent court, until the issuance of a judgment in the administrative case, or its preparation by the competent authority. After depositing it with the court clerk's office, it must take all the procedures granted to it by law to make the administrative case valid for judgment.
If it appears to us that there is no state commissioner or state commissioners body in the Jordanian Administrative Judiciary Law No. (27) of 2014, bearing in mind that it is of recent origin and did not take into account the idea of preparing the administrative case applied in France and Egypt, which would have a large and effective role in preparing the case for pleading. up to the final verdict.
The administrative judicial ruling issued in the administrative case is also affected by the preparation and preparation of the case through the state commissioner, as the judicial ruling issued to annul the administrative decision enjoys the authority of the ordered order, like all other peremptory judicial rulings, and this authority is not limited to the ruling of cancellation, but rather includes judicial rulings issued By rejecting the lawsuit, the judgment of jurisdiction, the judgment of acceptance, and the judicial ruling issued to stop the implementation of the administrative decision.
