تدور فكرة البحث حول مدى أهمية دور القضاء الإداري والدستوري في حماية فكرة الحقوق المكتسبة ضد تعسف جهة الإدارة؛ وذلك حفاظاً على المراكز القانونية والحقوق المكتسبة للأفراد, فالرقابة القضائية تعتبر أهم صور الرقابة في الدولة, وذلك لما يتوفر لدى القضاء من الضمانات التي تكفل له العمل بنزاهة واستقلال.
ولذلك, فقد تم تناول البحث من خلال مبحثين؛ فالمبحث الأول يتضمن موقف أو دور القضاء الإداري المصري في حماية فكرة الحقوق المكتسبة, ويشمل هذا المبحث الأثر الرجعي للإلغاء القضائي المصري للقرارات الإدارية, فضلا إلى تطبيقات القضاء الإداري المصري بضرورة احترام فكرة الحقوق المكتسبة, والمبحث الثاني تم فيه تناول دور القضاء الدستوري المصري في حماية الحقوق المكتسبة وتطبيقاته في هذا الشأن.
ويظهر دور القضاء الإداري المصري في حماية فكرة الحقوق المكتسبة من خلال أخذه بمبدأ عدم رجعية القرارات الإدارية, وذلك بهدف في حماية الحقوق المكتسبة أو المراكز القانونية الذاتية التي اكتملت للأفراد, وهذا ما أعلنه القضاء الإداري المصري ويؤكده باستمرار, وذلك من خلال عدم جواز المساس بالحقوق المكتسبة إلا بمقتضى قانون ينص على الأثر الرجعي؛ وذلك حرصاً على المصلحة العامة التي تقتضى الحفاظ على استقرار المراكز القانونية للأفراد وحقوقهم المكتسبة, إلا إنه يشترط وفقاً لذلك ليكون الحق مكتسباً أن يكون قد قام وفقاً للقواعد القانونية الصحيحة, وذلك حتى يكون أولى بالحماية.
وهنا لابد من بيان أن وجود رقابة قضائية على مشروعية تصرفات الإدارة يمثل ضمانة مهمة من ضمانات حقوق الأفراد وحرياتهم, لما في ذلك من تأسيس لشرعية دولة القانون, ثم بعد ذلك تم تناول الأثر الرجعي للإلغاء القضائي المصري للقرارات الإدارية كمظهر من مظاهر حماية فكرة الحقوق المكتسبة للأفراد وكيف أنه يتماثل مع قرار السحب الإداري من جانب الإدارة لقراراتها في إعدام القرار الإداري وجعله كأن لم يكن, وذلك من خلال انتهاء أو إزالة كافة الآثار المترتبة على القرار الإداري وذلك بالنسبة للماضي والمستقبل معا, وكأنه لم يصدر قط, ويظهر أيضاً من خلال البحث مدى وجود تطبيقات قضائية إدارية ودستورية تؤكد مدى حماية فكرة الحقوق المكتسبة للأفراد.
Abstract:
The idea of research revolves around the importance of the role of the administrative and constitutional judiciary in protecting the idea of acquired rights against the abuse of the administration, in order to preserve the legal positions and the acquired rights of individuals. And independence.
Therefore, the research has been dealt with through two topics. The first topic includes the position or role of the Egyptian administrative judiciary in protecting the idea of acquired rights, and this topic includes the reactionary effect of the Egyptian judicial cancellation of administrative decisions, as well as the applications of the Egyptian administrative judiciary with the necessity to respect the idea of acquired rights, and the second topic has been completed. In it, he dealt with the role of the Egyptian constitutional judiciary in protecting acquired rights and its applications in this regard.
The role of the Egyptian administrative judiciary in protecting the idea of acquired rights appears by adopting the principle of non-retroactivity of administrative decisions, with the aim of protecting acquired rights or self-legal centers that have been completed for individuals, and this is what the Egyptian administrative judiciary has declared and affirms continuously, by not prejudice to acquired rights Except according to a law that provides for retroactive effect, in the interest of the public interest that requires preserving the stability of the legal positions of individuals and their acquired rights, but it is stipulated accordingly for the right to be acquired that it has been established in accordance with the correct legal rules, so that it is the first to protect.
