هذه الدراسة هي دراسة فقهية تربوية قانونية من مسائل التشريع الإسلامي مرتبطة ارتباطا وثيقا بالمحاكم الشرعية، والقضاء الشرعي الأردني، والتي بنيت أحكامها على أحكام التعاون والتكافل الاجتماعي ورفع المشقة الحرج عن الناس، وانعكاسات ذلك على الفرد والأسرة في المجتمع المسلم، وذلك باتباع المنهجين الاستقرائي، والاستنباطي التحليلي العملي، ركزت على القيم المقاصدية الغائية المتضمنة في النفقات الشرعية – نفقات الأقارب - من الأب، والأم، وغيرهم من درجات الأقارب، مدعمة بمواد قانون الأحوال الشخصية الأردني رقم 15 لعام 2019م، وإجراءات التقاضي والسير بتلك الدعاوى في المحاكم الشرعية الأردني، مع القرارات الاستئنافية الصادرة في ذلك، مع مراعاة قانون أصول المحاكمات الشرعية الأردني رقم 31 وتعديلاته حتى عام 2016م.

This study is a jurisprudential, educational, legal study of issues of Islamic legislation closely linked to the Sharia courts and the Jordanian Sharia judiciary, and whose rulings are based on the provisions of cooperation and social solidarity and the removal of critical hardship from people, and the repercussions of that on the individual and the family in Muslim society, by following the inductive and deductive approaches. Practical analysis, focused on the ultimate purposeful values included in the legal expenses - the expenses of relatives - from the father, mother, and other degrees of relatives, supported by the articles of the Jordanian Personal Status Law No. 15 of 2019 AD, and the procedures for litigation and the conduct of these cases in the Jordanian Sharia courts, with the appellate decisions. Issued in this regard, taking into account the Jordanian Sharia Procedures Law No. 31 and its amendments until 2016 AD.
