تعتبر جريمة الخيانة الزوجية في الفضاء الرقمي من أخطر الجرائم الأخلاقية التي تضرب المجتمعات وتهدمه، لكونها لها علاقة مباشرة بالأسس التي يقوم عليها النظام الإجتماعي للدولة، باعتبارها النواة الأولى المكونة لها والمتمثلة في مؤسسة الأسرة .
وقد ظهرت الخيانة الزوجية الإلكترونية نتيجة التطور التكنولوجي والاستخدام المتنامي لوسائل الاتصال الحديثة (مواقع التواصل الاجتماعي) بين الزوجين، وما ينتج عن ذلك من خلافات زوجية تؤدي إلى التفكك الأسري، وبناء على ذلك ستحاول هذه الورقة البحثية إعطاء تعريف لجريمة الخيانة الزوجية الإلكترونية في الفقه الإسلامي والقانون الجنائي الوضعي، مع رصد أركان تحقق جريمة الخيانة الزوجية في القانون الجنائي المغربي والمصري، و إعطاء تفصيل لصور الخيانة الزوجية الافتراضية من خلال مواقع التواصل الاجتماعي،
وقد وتتعدد هذه الصور حسب الفعل المادي المجسد للجريمة، والوسيلة المستعملة في إرتكابها فقد يتجلى الأمر في محادثة جنسية للطرف الآخر عن أسرار الزوجية والفراش عبر التقنيات الحديثة، والانخراط في الأحاديث الجنسية وتبادل الرسائل العاطفية والجنسية وإرسال صور وفيديوهات غير أخلاقية وإرسال العبارات المثيرة جنسياً وإرسال صور غير أخلاقية عن أنفسهم والتعري أمام كاميرات ليشاهدها الآخر أو من خلال المواعدة الإلكترونية عبر الفضاء الإفتراضي، ومن بين الأثار المترتبة عن إرتكاب جريمة الخيانة الزوجية الإلكترونية في الفضاء الرقمي هو إنحلال الرابطة الزوجية بين طرفي عقد الزواج من خلال اللجوء الطرف المتضرر إلى القضاء الأسري بعد إثبات الفعل الجرمي المجسد للخيانة بين الزوجين والمطالبة بحل ميثاق الزوجية وفق مقتضيات مدونة الأسرة.
كما قمت بتناول موقف القضاء المغربي والمقارن من جريمة الخيانة الزوجية الإلكترونية ووسائل إثباتها، وصولا في ختام هذا البحث لمجموعة من النتائج والتوصيات.
 
Abstract:
The crime of marital infidelity in the digital space is considered one of the most dangerous moral crimes that strike and destroy societies, because it has a direct relationship to the foundations on which the state's social system is based, as its first constituent nucleus, represented by the family institution.
Electronic marital infidelity has emerged as a result of technological development and the growing use of modern means of communication (social networking sites) between spouses, and the resulting marital disputes that lead to family disintegration. Accordingly, this research paper will attempt to give a definition of the crime of electronic marital infidelity in Islamic jurisprudence and law. Positive criminal law, while monitoring the elements of investigating the crime of marital infidelity in Moroccan and Egyptian criminal law, and giving details of images of virtual marital infidelity through social networking sites,
These images may vary depending on the physical act embodying the crime, and the means used to commit it. The matter may manifest itself in a sexual conversation with the other party about marital secrets and bedtime through modern technologies, engaging in sexual conversations, exchanging emotional and sexual messages, sending immoral pictures and videos, sending sexually provocative phrases, and sending inappropriate images. morally about themselves and being naked in front of cameras for the other to watch or through electronic dating via virtual space, and among the effects resulting from committing the crime of electronic marital infidelity in the digital space is the dissolution of the marital bond between the two parties to the marriage contract through the affected party resorting to the family judiciary after proving the criminal act. The embodiment of betrayal between spouses and the demand to dissolve the marital covenant in accordance with the requirements of the Family Code.
I also discussed the comparative position of the Moroccan judiciary on the crime of electronic marital infidelity and the means of proving it, arriving at the conclusion of this research with a set of results and recommendations.
