لقد كان المشرع حريصًا في قانون تنظيم التعاقدات التي تبرمها الجهات العامة رقم ١٨٢ لسنة ٢٠١٨، على إنشاء منظومة إدارية متكاملة للتعاقدات العامة؛ ولذلك خصص الفصل الثاني من الباب الأول لـ«التنظيم المؤسسي للتعاقدات العمومية»، ونص على إنشاء إدارة للتعاقدات العامة، وإنشاء لجنة للمؤشرات والتغيرات الاقتصادية، ومكتب لشكاوى التعاقدات العمومية، هذا فضلًا عن تحديد الاختصاصات والمهام التي تتولاها الهيئة العامة للخدمات الحكومية في مجال التعاقدات العامة. كل هذا على خلاف الوضع في قانون المناقصات والمزايدات الملغى الذي كان فقيرًا من هذه الناحية؛ حيث إن معالم التنظيم الإداري للتعاقدات الحكومية في ظله، لم تكن بالوضوح الكافي الذي يتلاءم ويتناسب مع أهمية هذه التعاقدات، بوصفها جزءًا جوهريًّا من منظومة إدارة المالية العامة، وذلك بالنظر إلى كِبر حجم التعاقدات التي تبرمها الجهات العامة. ومن هنا رأينا، أنه من المهم إفراد دراسة لموضوع المنظومة الإدارية للتعاقدات العامة، نقف من خلالها على ماهية تلك المنظومة ومكوِّناتها وتشكيلها ونظام عملها، وبيان اختصاصاتها، مع إبراز المفاهيم الجديدة التي أرساها قانون التعاقدات، وإيضاح أن التعاقدات العامة لا ترتبط فقط بإجراءات الطرح وطرق التعاقد، وإنما تنطوي على إجراءات ما قبل الطرح، وتتعلق بمرحلة ما بعد الترسية، كل هذا على التفصيل الذي سيرد في سطور هذا البحث.   Abstract: The Legislator was keen, in Law No. 182 of 2018 regulating contracts concluded by Public Entities, to establish an integrated administrative system for public contracting; therefore he dedicated the Second Chapter of Part One of the said Law to "Institutional Organization of Public Contracts". The Legislator also provided for the establishment of a Department for Public Contracts as well as a Committee for Economic Indicators and Changes, and an Office for Complaints relating to Public Contracts. In addition, he defined the competencies and tasks assumed by the Public Authority for Government Services in the field of public contracting. This is unlike the situation under the repealed Tenders and Bids Law, which lacked equivalent provisions in this regard. In fact, the features of the administrative organization of public contracts under the said Law were not clear enough to suit and commensurate with the importance of the respective contracts, which are considered an essential part of the public finance management system, given the large size of contracts concluded by public entities. Hence, we find it important to devote this paper to the study of the “Administrative System for Public Contracts". In this Paper, we will touch upon the nature of that system, its components, its composition, its work system, and its competencies, with a special focus on the new concepts introduced by the new Public Contracting Law, and with the aim of clarifying that the study of public contracts is not limited only to tendering procedures and contracting methods, but it also involves the pre-tendering procedures, and the post-award stage, as will be explained in greater detail hereinunder.
