وردت أحاديث نبوية تخبر عن همِّ النبي ﷺ بفعل أمورٍ ثم تركه لها، وقد تساءلت كثيرًا عن مشروعية الاستناد لهذا الهمّ النبوي في استنباط الأحكام، لكنني لم أجد إجابة شافية عن هذا التساؤل؛ لعدم تعرض كثير من الأصوليين لمسألة الهم النبوي، ونُدرة ما ذكر عنه في كتب الأصول، وقد أدى عدم التعرض لذكره إلى شيوع القول بأن أكثر الأصوليين لا يقولون بحجية الهم النبوي، ولا يعدونه من السنة النبوية، مما دفعني للقيام بدراسة استقرائية تحليلية للنصوص الواردة في الهمّ النبوي، مع تأمل اجتهادات العلماء واستنباطهم من تلك النصوص، فظهر لي بصورة جلية، وتأكد لدي -بما لا يدع مجالا للشك- أن كثيرًا من العلماء -على اختلاف مذاهبهم- يرون حجية الهمّ النبوي، ويستدلون به، ويستنبطون منه الأحكام، مما يرجح القول بحجيته، ويصحح الخطأ في نسبة القول بعدم حجيته لأكثر الأصوليين؛ لأنهم وإن لم ينصوا على القول بحجيته، فإن ذلك يتخرج من استنباطاتهم واستدلالاتهم. ولم يزل تخريج الأصول من الفروع طريقة متبعة لمعرفة أصول الأئمة التي لم ينصوا عليها ولم يصرحوا بها، وبهذه الطريقة يمكننا التحقق من صحة نسبة الأقوال الأصولية، وتخريجُ أصولٍ تبنى عليها الفروع والأحكام. وهذا مما يبين أهمية إفراد المسائل الأصولية بالدراسة والبحث والتدقيق، ويؤكد أن باب الدراسات الأصولية ما زال مفتوحًا أمام الباحثين الجادين.   Abstract: there are some prophetical speeches informing about the Prophet worries ( peace be upon him ) to do specific matters and his abandonment of them, as I have questioned several times of its legacy and their assist of the worries  prophetically , as I could not find a clear answers for those questions, as many of the fundamentalists were not dealt with the prophet worries problems, and the rare of what have been mentioned in the fundamentals books  as this non dealing have led to the prevails of speeches that many of the fundamentalists are not stating the arguments of the prophet worries, as  they are not considered as a Prophetical Sunna, in which emerged me to develop a deep study with analytical and indications sense about the prophetical worries that mentioned in them with a contemplation of the scientists endeavors and their foreseen about those speeches so I have discovered a clear picture and I have ensured with no doubt that many of the scientists have different sectarians as they can see the arguments of the prophetical worries and lead them to what are explored of many judgments in which relied on the weighty arguments as verified the misleading in the relativeness of the speeches to the fundamentalists, because that have not stated the speech with the arguments as those have been extracted from their elicitation and their evidences as it is still the extraction of the fundamentals from the branches a method followed to know the Imams fundamentals whom are not stating them and were not prevailed by them so  in this way, we can investigate the verification of the relativeness  of the fundamentals speeches and extracting the fundamentals that based on their branches and provisions , as this will show the importance of the individuality of the fundamentals problems by studying and research and accuracy and they will be accentuated that the topic of fundamentals  studies  are still open for the series scholars
