عقد البوت                            أماني أحمد بركات الطراونه قسم القانون العام " القانون الاداري "، كليه الحقوق، جامعه طيبه المملكة العربية السعودية البريد الإلكتروني: Aatarawneh@taibahu.edu.sa ملخص: عقد البوت يوفر مرافق مدنية للبلاد، وذلك من دون إثقال ميزانية الدولة بما يكلفها ماليًا، لصرفها في مصالح وطنية أخرى، يجلب مهارات الهيئات العامة المتخصصة المؤهلة في مشروع معين، وإدارته بكفاءة بعد الانتهاء منه. تدريب العمالة الوطنية؛ حيث أنه هذا النوع من العقود يعطي الفرصة للعمالة الوطنية على التدريب لإدارة المشروع بكفاءة بعد انتهاء فترة العقد، وتحويل المشروع إلى إدارة البلاد، كما يتم إلزام الهيئة العامة المنفذة للمشروع بتدريب العناصر المحلية التي سوف تتولى تشغيل وصيانة المشروع بعد تسليمه للحكومة تلتزم الشركة المنفذة للمشروع بتسليم كل متعلقات المشروع من تكنولوجيا ومعدات وخلافه في نهاية فترة الامتياز دون تعويض، تسترد الهيئة العامة المنفذة للمشروع المقاولة تكاليف المشروع، والأرباح المقدرة لها منه من تشغيله. تتحمل الهيئة العامة المنفذة للمشروع صيانة المشروع حتى تسليمه بحالة جيدة وتزداد أرباح الهيئة العامة المنفذة للمشروع كلما طالت المدة، وكانت جودة المشروع عالية الكلمات المفتاحية: عقد، البوت، عقد البناء، عقد التصميم، التأجير التمويلي.                                  Bot contract                     Amani Ahmed Barakat Tarawneh Department of Public Law “Administrative Law" Faculty of Law, Taibah University, Kingdom                         of Saudi Arabia.            E-mail: Aatarawneh@taibahu.edu.sa Abstract: The bot contract provides civil facilities for the country, without burdening the state budget with financial costs to be spent on other national interests. The public authority implementing the project is also obligated to train the local elements that will undertake the operation and maintenance of the project after it is handed over to the government. The company implementing the project is committed to handing over all project belongings, including technology, equipment, etc., at the end of the concession period without compensation The public body implementing the project shall recover the costs of the project and its estimated profits from its operation. The public authority implementing the project is responsible for maintaining the project until it is delivered in good condition, and the profits of the public authority implementing the project increase the longer the period lasts, and the higher the quality of the project.
