رسالة الكفاءة لقاضي القضاة عمر بن إسحاق بن أحمد سراج الدين الهندي الحنفي (ت: 773هـ) تحقيقًا ودراسة عبد المجيد بن محمد بن علي بجوي قسم الدراسات القضائية، كلية الشريعة، الجامعة الإسلامية بالمدينة المنورة، المملكة العربية السعودية البريد الالكتروني: am.bajawi@gmail.com الملخص: الحمد لله رب العالمين، والصلاة والسلام على سيد الأنبياء والمرسلين، وبعد: فقد حرص الإسلام على حفظ النسل الإنساني، وحمايته، وشرع لذلك الزواج الشرعي، وبين شروطه، وحث على اختيار الزوجة الصالحة، وكذلك حث أولياء المرأة على قبول الرجل الصالح، ومن الأمور التي ذكرها العلماء في هذا الباب الكفاءة، ومن المؤلفات فيها: "رسالة الكفاءة" للقاضي عمر بن إسحاق بن أحمد سراج الدين الهندي الحنفي، ت: 773هـ، وسوف أقوم بتحقيق هذه الرسالة، وقد اعتمدت في تحقيق هذه على الرسالة على نسخة واضحة حسنة من جامعة الملك سعود. واخترت هذه الرسالة لأهمية موضوع الكفاءة، وبيان موقف أهل العلم فيها، وبسبب غلبة العادات والتقاليد في المجتمع في اختيار الكفؤ. وقد استدعى منهج التحقيق تقسيم هذا البحث إلى قسمين: الأول: قسم الدراسة، وفيه دراسة عن مؤلف هذه الرسالة، ودراسة عن رسالته. الثاني: قسم التحقيق، وفيه تحقيق هذه الرسالة من أولها إلى آخرها. واعتمدت في تحقيق هذه الرسالة على المنهج العلمي المتبع في الجامعات والمراكز البحثية. الكلمات المفتاحية: الكفاءة، سراج الدين الهندي، رسالة الكفاءة.   Competency letter to Chief Justice Omar bin Ishaq  bin Ahmed Siraj al-Din al-Hindi al-Hanafi  (d. 773 AH), investigation and study Abdal majid bin mohamad bin Ali  Bagwi Department of general jurisprudential  J udge of high  appeal court of Gazan   \ kingdom of Saudi Arabia Email: am.bajawi@gmail.com Abstact : Praise be to Allah, the Lord of all worlds, and peace blessings be upon the Master of the Prophets and Messengers, and after: Islam has been keen on preserving and protecting humans, and has legislated for that purpose lawful marriage, specifying its conditions, and encouraging the selection of a righteous spouse. It also encourages the guardians of women to accept a righteous man. One of the matters mentioned by scholars in this regard is competence, and one of the works on this topic is "Risalat al-Kafa'ah" by Judge Umar bin Ishaq bin Ahmad Siraj al-Din al-Hindi al-Hanafi, died in 773 AH. I will work on verifying this treatise, relying on a clear and good copy from King Saud University. I have chosen this treatise due to the importance of the topic of competence and to clarify the stance of scholars regarding it, and due to the dominance of customs and traditions in society in selecting the qualified. The research methodology necessitated dividing this study into two sections: The first section: the study section, which includes a study on the author of this treatise and a study on his treatise. The second section: the verification section, which includes verifying this treatise from beginning to end.
