أثر الصنعة على مبادلة الربوي بجنسه موضي بنت صالح اللحيدان قسم الفقه، كلية الشريعة، جامعة الإمام محمد بن سعود، المملكة العربية السعودية. البريد الإلكتروني: moda- alahidan@gmail.com الملخص: فإن الله خلق الإنسان في أرضه، وأخرج له من كنوزها ما تستقيم به حياته، وتزين بها أحواله، فوهب له الذهب والفضة وغرس في الفطر كونها أثمانًا بأعيانها على مر العصور، ومن الزينة التي تباح للمرأة. كما وهب له مما تنبت الأرض من المطعومات التي يقتات بها ويهنأ بالعيش مع لذاتها. وكما متعه بخيراتها، حرم عليه ما يوقع ظلم الناس، ومن أشد الظلم الربا، حيث إنه أكل لأموال الناس بالباطل، وسبب الأنانية وحب الذات. لذا كان لزاما على المسلم معرفة حدود الربا، ليحصل تمام بعده عنه وسلامته منه. ومن الأمور التي يذكرها الفقهاء ويستشكلونها في الربا دخول الصنعة في أصنافه ومدى تأثيرها عليها، وهل تخرجها عن الربوية أو لا. ويهدف هذا الموضوع إلي بيان مدى تأثير الصنعة على الأصناف الربوية وحكم التبادل بها بعدها بين جنسها الربوي الأصلي قبل دخول الصنعة وبين بعضها. وسوف أقول بإتباع المنهج التحليلي من خلال تصوير المسألة المراد بحثها تصويرا دقيقا قبل بيان حكمها ليتضح المقصود من دراستها، وإذا كانت المسألة من مواضع الخلاف فأذكر حكمها بدليلها مع توثيق الاتفاق من مظانه المعتبرة. وقد توصل الباحث إلي عدة نتائج منها أن الصحيح أن الصنعة في الأصناف الأربعة وما يقاس عليها لا تخرجه من الربويات، لكنها تعتبر جنسا مخالفا لأصله فتجوز مبادلة المصنوع بجنسه قبلها بشرط التقابض، كخبز البر بالبر. أن المصنوع ذو المسمى الواحد جنس واحد وإن اختلفت أصوله. أن الصحيح جواز مبادلة المصنوع ببعضه البعض. الكلمات الافتتاحية: الصنعة، المبادلة، الأموال الربوية، مبادلة الربا، الذهب، الفضة.             The effect of craftsmanship on the exchange of usury for its gender Modi bint Saleh Al-Luhaidan Department of Jurisprudence, College of Sharia , Imam Muhammad bin Saud University Kingdom of Saudi Arabia.. E-mail: moda-alahidan@gmail.com Abstract: God created man on His earth, and brought forth for him from its treasures what would improve his life and adorn his circumstances, so He gave him gold and silver and instilled in the nature that they are precious prices throughout the ages, and among the adornments that are permissible for women. He was also given what the earth grows from the seeds that he feeds on, and he enjoys living with its own pleasures. Just as he enjoys its good deeds, he is forbidden from doing anything that causes injustice to people, and one of the worst injustices is usury, as it is consuming people's money unjustly and is the cause of selfishness and self-love Therefore, it is necessary for a Muslim to know the limits of usury, in order to completely distance himself from it and be safe from it. Among the matters that jurists mention and question regarding usury is the entry of workmanship into its types and the extent of its effect on them, and whether it excludes usury or not. Hence, I chose the topic (The effect of craftsmanship on the exchange of interest for its kind), so that this will become clear, God willing, at the conclusion of the research. Due to the accuracy of the issues, the statements were followed by the sayings of the scholars of each sect. By God, I ask for success, guidance, payment, and good delivery. This topic aims to explain the extent of the impact of industry on usurious types and the ruling on exchanging them afterwards between their original usurious type before the introduction of the industry and some of them. I will say that the analytical approach is followed by accurately depicting the issue to be studied before stating its ruling so that the purpose of its study becomes clear. If the issue is one of the areas of disagreement, then state its ruling with its evidence while documenting the agreement from its considered points of view. The researcher reached several conclusions, including that what is correct is that craftsmanship in the four types and what is measured against them does not exclude it from usury, but it is considered a type that is contrary to its origin, so it is permissible to exchange the workmanship for its previous type on the condition of exchange, like wheat bread for wheat. A product with the same name is of the same type, even if its origins differ. The correct view is that it is permissible to exchange manufactured goods for each other.
