إن من أمن أعظم أصول الاستدلال في شريعة دين الإسلام هو الإجماع، وقد عصم الله هذه الأمة أن تجتمع على ضلالة؛ ولأجل هذا اهتم علماء الإسلام بهذا الأصل العظيم، إذ إن كل مسألة أجمعت عليها الأمة فهي حق.وإن حكايات الأئمة المتقدمين للإجماع في مسائل الفقه لها مزية عن الإجماعات التي حكاها من جاء بعدهم من العلماء؛ وهي: قلة الخلافات في عصرهم بالنسبة لمن جاء بعدهم، وعدم تشعب الأقوال بالنسبة لزمان المتأخرين.وفي هذا البحث قمت بجمع ودراسة الإجماعات الفقهية التي حكاها إمام من الأئمة المتقدمين، وهو أبو عبيد القاسم بن سلام (ت224هــ)([1]).وكان عملي في هذه المسائل: هو ذكر كلام أبي عبيد، ثم أذكر من وافقه في نقل الإجماع، وبيان مستند الإجماع، مع الحرص على ذكر أكبر قدر ممكن من المخالفين في المسألة، ثم النظر في هذا الخلاف المذكور هل يقدح في الإجماع، أم لا، وأذكر هذا في خلاصة كل مسألة، عند الانتهاء منها.

Abstract:
One of the most secure principles of inference in the sharia of the religion of Islam is unanimity, and Allah has decreed the nation of Muhammad to meet on a stray; for this reason, Islamic scholars paid attention earlier and later to this great Origin, because every issue on which the nation is unanimous is a right.The stories of the imams who applied for consensus in matters of jurisprudence have an advantage over the consensus told by those who came after them from the scholars, namely: the lack of differences in their era for those who came after them, and the lack of ramifications of sayings for the time of the latecomers.In this research, I collected and studied the Fiqh consensus narrated by one of the advanced imams, Abu Ubaid Al-Qasim Ibn Salam (d.224 ah), and these issues address, among others, the chapters of Zakat ([2]).My job in these matters was to mention the words of Abu Ubaid, then I would mention those of the imams who agreed with him in conveying the consensus, and the statement of the consensus document, taking care to mention as many of the dissenters in the matter as possible, and then consider whether the said disagreement is permissible in the consensus narrated by Imam Abu Ubaid, or is not permissible in it, and I mention this in the summary of each issue, when it is finished.
