تُعد عدالة التعليم قضية محسومة بنص الدستور المصري والذي أکد في مادته "19 من الباب الثانى (المقومات الأساسية للمجتمع)" أن التعليم الأساسي المجاني حق تکفله الدولة لکافة أبنائها دون تمييز، ومن هنا کان مسمى العدالة لم تعد مصطلحاً للرفاهية بلى باتت حقا مکفولاً بموجب الدستور والقانون، ويترتب على ذلک حقوق يجب أن تصان، ويجب أن تحاط هذه الحقوق بآليات للمتابعة والمساءلة والمحاسبة. آليات تکفل للدولة حق منح الفرص للأبناء للتعليم الجيد، وتکفل للأبناء حقوق المطالبة بالعدالة التعليمية التي هي في مجملها واجب تلتزم الدولة بتقديمه وليست مظهراً من مظاهر الرفاهية تمن به الدولة على أبنائها. هذا الالتزام ينبغى أن تقوم به الدولة لتضمن توفير حق التعليم عالى المستوى والمتميز لکل مواطن من أبناء الوطن منذ ميلاده وحتى وفاته.
ويهدف البحث إلى التعرف على أبعاد العدالة التعليمية. والتعرف على المعوقات التي تواجه رياض الأطفال في مصر، والتوصل إلى آليات تمکين الأطفال من حقوقهم في التعليم في ضوء مبادئ العدالة التعليمية.
منهج البحث اعتمد البحث على المنهج الوصفي.

The requirements for empowering children of their rights to education in light of the principles of educational justice
Educational justice is considered adetermined issue by the text of the Egyptian constitution, which affirmed in article 19 of the second chapter (the basic elements of society), that the free basic education is aright which is guaranteed by the state for all people without discrimination, so the concept of justice no longer a term of luxury, but it is aright guaranteed by the constitution and the law. This resulted in rights must be preserved and must be surrounded with mechanisms of accountability and monitoring. These mechanisms guarantee for the state, the right of good education for their children and rights of requiring with educational justice which is a duty of the state, and it's not a luxuary.
This obligation must be carried out by the state to ensure that. The research aims at recognizing the conceptual frame work of administrative creativity, recognizing the dimensions of excellence in the educational institutions and reaching mechanisms of improving the administrative creativity to achieve excellence in pre-university education institutions in Egypt.
